This Settlement and Release Agreement (“Agreement”) is being entered into by Harry G. Mitchell (“Mr. Mitchell”) and Echo Therapeutics, Inc. (“Echo” or the “Company”) and its President and Chief Executive Officer, Patrick T. Mooney (“Dr. Mooney”) (together, the “Echo Parties”) (the Echo Parties and Mr. Mitchell are collectively referred to herein as the “Parties”).
