Agreement is terminated or expires, for any reason or under any circumstance whatsoever. In addition, any losses suffered by Mortgage Loan Seller in connection with such termination or expiration are recourse to the borrower and guarantor. (13) Actions Concerning Mortgage Loan Arrowhead and Entrada Apartments (No. 24) As of the date of origination, the guarantor was the subject of two federal tax liens and three lawsuits. The tax liens were filed on June 1, 2012 and July 24, 2012 in the amounts of $1,843,300.80 and $1,386,541.01, respectively. (16) Insurance Highwoods Square (No. 41) A portion of the related Mortgaged Property is operated as a CVS drugstore, under a lease to a CVS affiliate that is guaranteed by CVS Corporation. The terms of the related lease obligate the tenant to restore its premises, a freestanding building, following any casualty; the related insurance is maintained by, and the insurance proceeds are paid to and held by, the tenant.
