Reference is made to that certain Amended and Restated Capacity Purchase Agreement, dated as of November 19, 2020, but effective as of January 1, 2021, between AMERICAN AIRLINES, INC. (“American”) and MESA AIRLINES, INC., a Nevada corporation (together with its successors and permitted assigns, “Contractor”) (as amended, supplemented or otherwise modified from time to time in accordance with the terms thereof, the “Capacity Purchase Agreement”).
