The public comment period required by Paragraph 109 of the above-mentioned Administrative Settlement Agreement and Order on Consent (Agreement) has closed. EPA reviewed and responded to comments. Pursuant to one of the comments, EPA determined that Paragraph 79 needed to be amended to reference Paragraph 74.d through 74.g, instead of Paragraph 74.a through 74.e. Accordingly, all parties have agreed to the amended Agreement. This letter establishes July 17, 2023 as the Effective Date of the Agreement. In addition, this letter closes the previous Administrative Agreement and Order on Consent, CERCLA docket CERCLA-08-2018-0004. Please feel free to contact me with any questions.

On April 21, 2020, the U.S. Environmental Protection Agency (EPA) reviewed and approved PPG Industries, Inc’s (PPG) submittal entitled “Final Remedial Investigation Report, Riverside Industrial Park Superfund Site, April 20, 2020” (April 2020 RIR). It was brought to EPA’s attention that two spills noted in Section 1.4.4 of the approved April 2020 RIR was incorrectly listed for Lot 59 but should have been attributed to Lot 57. The two spills are noted below:

Adit Administrative Settlement Agreement and Order on Consent: A horizontal opening into an underground mine from the side of a hill or mountain. A legal agreement between EPA and an individual, business, or other entity requiring the other entity to perform or refrain from performing specified actions or to pay specified costs. ASAOCs apply to civil causes of action and can be enforced in court. They describe the required or proscribed actions, and may be subject to a public comment period.ASAOCs are commonly used for removal actions and RI/FSs, but also may be used for de minimis and cost recovery settlements. Administrative Record: The body of documents that "forms the basis" for the selection of a particular response at a site. For example, the AR for remedy selection includes all documents that were “considered or relied upon" to select the response action. The Ross‐Adams Mine Site is a former uranium mine located in the Tongass National Forest near the southern end of Prince of Wales Island, Alaska. The Ross‐Adams Mine was mined by open pit and then later by underground operations intermittently between 1957 and 1971 by several different mining companies.
