The International Carriage of Perish- able Foodstuffs Act assigns to the Sec- retary of Agriculture the responsibility for implementation of the Agreement on the International Carriage of Per- ishable Foodstuffs and on the Special Equipment to be Used for Such Car- riage (ATP). The purpose of this rule is to establish procedures for the inspec- tion, testing, and certification of insu- lated, refrigerated, mechanically re- frigerated, and heated transport equip- ment in accordance with the Act and the standards specified in the Agree- ment. In the process, the intent is to utilize existing industry organizations and facilities for testing and inspection of equipment. The Secretary is the sole authority to issue certificates of com- pliance.

First of all the Federal Republic of Germany objects to the proposed deletion of Article 2, third sentence of the ATP. According to this sentence each Contracting Party can recognize the validity of certificates stating the compliance with the standards of the ATP and issued by the competent authorities of Non-Contracting Party in conformity with the requirements of annex 1, appendices 1 and 2 to this Agreement. There is no apparent reason why this form of recognition should no longer apply.

On 9 September 2015, the Government of Finland notified the Secretary-General, pursuant to article 18 (2) (a) of the Agreement, that it has an objection to the proposal of amendment No. 3 regarding Annex 1, appendix 2, paragraph 3.2.6, which was transmitted by C.N.181.2015.TREATIES- XI-B-22 of 19 March 2015. The Transport Division of the United Nations Economic Commission for Europe has confirmed that the proposal to which Finland is objecting is independent of the other nineteen (19) proposals contained in C.N.181.2015.TREATIES-XI-B-22. The Government of Finland noted that it does not object to the remaining nineteen (19) proposals of amendment contained in the above-mentioned depositary notification.
