This Change Order made this day of April 2016 by and between the Town of Middlebury, a Vermont Municipality with a mailing address of 94 Main Street Middlebury, Vermont 05753 (hereinafter "Middlebury") and Addison County Regional Planning Commission, a governmental organization with an address of 14 Seminary Street, Middlebury, Vermont 05753 (hereinafter "ACRPC") amends the contract between the parties dated September 24, 2014 concerning consulting work ACRPC is performing on behalf of Middlebury as Municipal Project Manager to help Middlebury construct a sidewalk and other amenities on Exchange Street (the “Contract”).

The parties entered into a prevailing wage rate contract for construction on May 4, 2022. The parties intend this change order to modify their earlier contract only as to their expressions herein. The mutual promises of each are given in exchange and as consideration for, the promises of the other.

It is hereby mutually agreed that when this Change Order has been signed by the contracting parties, the following described changes shall be executed by the Contractor without changing the terms of the Contract, except as herein stipulated and agreed.
