This case concerns a piece of land measuring 182 acres. It is pertinent to mention at the outset that this land is located in the “prohibited zone”. This land came to vest with the respondents in 1891 wherein the land was gifted to Shahzada Nadir for his lifetime and one generation of legitimate male heirs. This is the substantive part of the contract/agreement reached by and between the parties and once the lifetime of Shahzada Nadir’s first generation ended, the property was meant to revert back to the Province. A presumed intention resulting trust could be said to arise in this instance as the original agreement did not envisage the respondents taking title absolutely. The last bona fide lessee, Shahzada Mohammad Akber, died in India in the year 1956. This is the point in time that the Government of Punjab became re-vested with the rights and ownership of the land and the respondent family ceased to have any rights over the said property.

The transfer process requires approvals from the Environmental Protection Agency (EPA) and the Tennessee Department of Environment and Conservation (TDEC) and generally takes up to 36 months to complete. All property transferred must meet regulatory requirements to protect human health and the environment and provides indemnification. DOE and TWRA agree to pursue the transfer of five properties (as described below).

JAYADEVAN (THRISSUR): The shifting of Thrissur town post office and transfer of land between the Postal department and Thrissur Corporation for the purpose of widening of Pattalam Road in the heart of Thrissur town was initiated in the year 2014. After a series of meetings between the Corporation and Chief Post Master General, Kerala Circle and a meeting with the then Union Minister of Communications, an agreement was executed between Postal department and Thrissur Corporation on 19-10- 2015. As per the agreement, the arrangements for temporary post office building were completed. A draft sale deed was given to the postal department on 30-01-2016 for approval. But it is learnt that the postal department in Kerala has not got the approval from Central government to transfer the land to the Corporation as yet, hence the delay in vacating the post office and transfer of the land to the Corporation.
