This Online Banking Access Agreement & Electronic Fund Transfer Act Disclosure (“Agreement”) will be effective as of the first day we make the Services accessible to you. Unless otherwise stated, any reference to the Agreement includes applicable schedules, enrollment forms and exhibits to the same, as well as applicable user guides, user manuals, set-up forms and other user materials, including online terms and information. Each time you access the Service, you confirm your agreement to these terms, as amended from time to time.

This Online Banking Access Agreement (“Agreement”) provides information about and states the terms and conditions concerning the Online Banking services (“Online Banking” or “DFCU Online”) offered to You through DFCU Financial. This Agreement applies to business accounts and shall be an addendum to the existing Business Membership and Account Agreement that You received upon opening Your account, and as amended, with DFCU Financial. The terms and conditions of Your Business Membership and Account Agreement, and any disclosures as well as any other agreements with DFCU Financial shall remain in effect notwithstanding any provision in this Agreement to the contrary. This Agreement does NOT apply to consumer accounts used primarily for personal, family, or household purposes.

The terms and conditions of the agreements and disclosures for each of your Sunmark Credit Union accounts as well as your other agreements with Sunmark Credit Union, such as loans, continue to apply notwithstanding anything to the contrary in this Agreement. This Agreement is also subject to applicable federal laws and the laws of the State of New York (except to the extent this Agreement can and does vary such rules or laws) including (but not limited to) the Electronic Signatures and Global and National Commerce Act (“E-SIGN Act”) and New York State’s Electronic Signatures and Records Act.
