The Arizona Department of Transportation (“ADOT”) invites Statements of Qualifications (“SOQs”) from prospective entities or groups of entities (“Proposers”) wishing to submit proposals to design, supply, build (including installation), finance, operate and maintain the Phoenix Metropolitan Area Freeway Lighting Project (the “Project”) through a Design-Build-Finance-Operate-Maintain (“DBFOM”) agreement (“P3 Agreement”). ADOT is issuing this Request for Qualifications (“RFQ”) under Arizona Revised Statutes (“A.R.S.”) Title 28, Chapter 22, Article 1 relating to Public-Private Partnerships (“P3”). ADOT plans to request Proposals from qualified firms short-listed through the SOQ process (“Short-Listed Proposers”) to perform the Project. Short-listing will be based on the SOQs provided by Proposers, as set forth in this RFQ.

The Shellpot Bridge is a 536-foot swing bridge located on a rail freight bypass route around Wilmington, Delaware. When the bridge failed in 1994, Conrail, then the bridge’s owner, elected not to repair it due to declining freight volume. The State of Delaware reached agreement with the new rail owner, Norfolk Southern Corporation, to provide funds to repair the bridge, with the railroad to pay tolls to repay the state’s investment. Recent volumes of traffic over the bridge indicate that, if traffic continues at its current level, Delaware will realize an annual return of 9.75% on its investment.

Landowners shall enter into an agreement regarding the scope and timing of required traffic improvements to mitigate the traffic related impacts of the project on SDOT‐H facilities as generally indicated in the project’s Pro Rata Share Calculations for Waikapu Country Town Project dated June 29, 2018, as approved by SDOT‐H. Alternatively, landowners may, subject to agreement with SDOT‐H, provide additional residential workforce housing units in the project in lieu of providing funding or constructing traffic improvements to mitigate the traffic related impacts of the project. The agreement shall be executed prior to the approval of the first subdivision application to the County of Maui for the project.
