MEXICAN TOMATO SUSPENSION AGREEMENT

On March 4, 2013, the Department of Commerce and Mexican producers/exporters of fresh tomatoes signed the latest agreement suspending the antidumping investigation on fresh tomatoes from Mexico. The investigation was a result of domestic complaints that Mexican tomatoes were being sold in the United States at below fair market prices. The basis of the agreement was a commitment by each signatory producer/exporter to sell Mexican tomatoes at or above an established reference price. All types of fresh tomatoes (including common round, cherry, grape, plum, pear and greenhouse tomatoes), except tomatoes that are for processing, are covered by this Agreement. Signatories of the agreement are required to label the tomatoes they export to the U.S. with the following:

Today, the Department of Commerce announced the termination of the 2013 Suspension Agreement on Fresh Tomatoes from Mexico, and that negotiations will continue regarding a possible revised agreement acceptable to the Mexican signatories which also addresses the concerns of the U.S. industry to the extent permissible by U.S. trade law. During the negotiations, Commerce will continue with the investigation and instruct Customs & Border Protection to collect cash deposits or bonds based on the preliminary determination by Commerce, which was issued in 1996. Any deposits collected will be refunded if a revised agreement is reached, or the U.S. International Trade Commission determines there is no injury based on its own independent investigation.
