You accept responsibility for paying all charges, including any extra charges arising under this contract. In this agreement: “Owner” means Barossa Landscape Supplies and its substitutes, successors and permitted assigns; “Hirer” means any person who signs this agreement personally or by an agent; “Goods” means the piece of equipment as described in the Schedule and any replacement for that Equip- ment together with all accessories and other equipment; “Hire Period” means the period beginning on the date set out in the Schedule as the Start Date and the ending on the date set out in the Schedule as the Expiry Date; “GST” has the same meaning as in (Goods and Services Tax) Act 1999 (Cth) “PPSA” means the Personal Property Securities act 2009 (Cth) and any regulations made pursuant to it.

These Hire Contract Conditions apply to the exclusion of any other conditions proposed by the Customer, unless otherwise agreed by Eastern Diggers and the Customer in writing. Eastern Diggers agrees to hire Equipment to the Customer on terms set out in this document. If the Customer wishes to hire Equipment the Customer must complete and sign (or otherwise accept in the manner required by Eastern Diggers) a Hire Schedule and such other documents as Eastern Diggers may require. Each Hire Schedule is not a separate contract but forms a part of this hire agreement between Eastern Diggers and the Customer, together with any credit application, guarantee and indemnity or other contractual documents. The Customer agrees to receive hire schedules and all associated documentation by electronic means. Eastern Diggers may in its absolute discretion decline to hire Equipment to the Customer at any time if it has reasonable cause to do so.

This Hire Agreement is between Dance Party Hire as indicated on the reverse side hereof (“Dance Party Hire”) of the one part and the person whose details appear on the reverse side hereof (the “Hirer”) of the other part. The “Equipment” is defined as all that equipment and all accessories as detailed on the front hereof, and any or all equipment supplied to the Hirer by Dance Party Hire. This agreement is hereafter referred to as the “Agreement”.
