The Trade Facilitation Agreement and Customs Formalities under the EPAChapter 4 of the EPA treats with Customs and Trade Facilitation; in particular, Article 31 indicates that the Parties’ respective trade and customs legislation and procedures shall draw upon international instruments and standards applicable in the field of customs and trade. Accordingly, over the past five years, CARIFORUM States and the EU have been taking action to implement the World Trade Organisation (WTO) Trade Facilitation Agreement (TFA), which seeks the simplification, harmonisation and modernisation of customs formalities to reduce the bureaucratic delays and red tape to move goods across borders. The newly approved and recently implemented Trade Facilitation Agreement is the first international trade agreement of its kind. It will make it easier for all member nations of the World Trade Organization, but especially developing nations, to participate in and profit from international trade. Perishable goods produced in small quantities – like food and other agricultural products grown on small-scale farms in developing countries – are difficult to sell in international markets. Often foods and other perishables spoil because they get caught in bureaucratic bottlenecks when crossing borders. The Trade Facilitation Agreement will remove these inefficiencies, making it easier for large and small exporters to benefit and facilitating global trade by removing regulatory obstacles and barriers at national borders.

This submission communicates preliminary information gathered by the LDC Group on challenges, difficulties, and ease of preparing notifications for Section II, and implementation of the Trade Facilitation Agreement (TFA) to date. In addition, the information includes feedback from exporters and importers on benefits and difficulties, and experiences on support provided, and desired improvements. The LDC Group devised an internal questionnaire for LDC Group Members to collect information from capitals in order to prepare this communication and add value in the LDC Group engagement in this first review of the TFA. Some delegations conveyed their experiences while implementing different provisions, and assistance for Category C measures. The information is not exhaustive, but intends to provide a snapshot of experiences reported so far.

The WTO Trade Facilitation Agreement (TFA) entered into force on 22 February 2017. It is a result of the Doha Round of Trade Negotiations, which was launched in 2001. The text of the TFA was adopted by WTO Members at the 9th Ministerial Conference in Bali, 3-6 December 2013. The Agreement entered into force in accordance with the provisions of Article X:3 of the WTO Agreement and Members have to individually accept the amendment of the WTO Agreement by depositing an instrument of acceptance for the Protocol of Amendment, adopted on 27 November 2014. In December 2013 WTO Members concluded negotiations on a new Trade Facilitation Agreement (WT/MIN (13)/36) aimed at expediting the movement, release and clearance of goods, including goods in transit, and at improving customs cooperation. The Agreement contains unique special and differential treatment (SDT) measures that link the requirement to implement with the capacity of developing countries and least developed countries (LDC) to do so. The Agreement also recognizes the need for donor Members to enhance assistance and support for capacity building.
