– hodnoty cien a odmien pre účastníkov spolu: 60 000 € bez DPH,
– predpokladanej hodnoty zákazky na poskytnutie služieb zadávanej v zmysle § 81 písm. h) ZVO: 1 000 000 € bez DPH,
5. Tieto súťažné podmienky boli prerokované porotou na úvodnom stretnutí poroty dňa 18.02. 2020 a schválené per rollam 04.03. 2020 a overené Slovenskou komorou architektov overením č. KA- 94/2020 zo dňa 10.03. 2020.
III. DRUH SÚŤAŽE

Cieľom prvého kola súťaže návrhov je nájsť najvhodnejšie riešenia predmetu súťaže pre postup do druhého kola, ktoré splnia požiadavky vyhlasovateľa, obsiahnuté v týchto súťažných podmienkach. V druhom kole budú postupujúce návrhy z prvého kola revidované odporúčaniami poroty a účastníkmi podrobnejšie do- pracované.
4. Expected value of the design competition:1 060 000 € excl. VAT, consisting of:
– values of the prizes and remuneration for the paticipants in total: 60 000 € excl. VAT,
– expected value of the contract for the provision of services assigned pursuant to Section 81(h) of the APP: 1 000 000 € excl. VAT,
5. These competition conditions were discussed by the jury at the initial jury meeting held on 18.02. 2020, approved per rollam 04.03. 2020 and certified by the Slovak Chamber of Architects by certifi- cation no. KA-94/2020 dated 10.03. 2020.
III. TYPE OF COMPETITION

The aim of the first round of the design competition is to find the best solutions of the competition’s subject, for qualification into the second round, which meet the Announcer’s requirements contained herein. In the second round, the designs qualified from the first round will be revised according to the recommendations of the jury and completed in detail by the participants.
IV. OKRUH ÚČASTNÍKOV
1. Táto súťaž návrhov sa vyhlasuje ako verejná pre vopred neurčený počet anonymných účastníkov.
2. Účastníkom v súťaži návrhov nesmie byť ten, kto:
a. vypracoval kritériá výberu účastníkov, vypracoval kritériá hodnotenia predložených návrhov;
b. je členom poroty, náhradníkom člena poroty, sekretárom súťaže, overovateľom súťažných návrhov alebo odborným znalcom prizvaným porotou;
c. overoval súťažné podmienky za Slovenskú komoru architektov;
d. je zamestnancom vyhlasovateľa;
e. je blízkou osobou, spoločníkom, štatutárnym orgánom, zamestnancom alebo zamestná- vateľom osôb vylúčených z účasti v súťaži návrhov podľa bodov (a) až (d).
3. Účastníkom môže byť jedine subjekt, ktorý má oprávnenie na výkon podnikania predstavujúceho činnosť uvedenú v § 4 zák. č. 138/1992 Zb. o autorizovaných architektoch a autorizovaných staveb- ných inžinieroch v zn. n. p. (ďalej „ZAA“) alebo podľa ekvivalentnej právnej úpravy platnej v krajine podnikania účastníka. Splnenie tejto podmienky je účastník povinný preukázať čestným vyhlásením, ktorého vzor je prílohou č. 2 týchto Súťažných podmienok.
4. V prípade účasti autorského tímu (riešiteľského kolektívu), musí podmienku odbornej spôsobilo- sti spĺňať aspoň jeden člen - účastník, ktorý bude splnomocnený ostatnými členmi riešiteľského kolektívu na predkladanie a nakladanie s návrhom v plnom rozsahu. Ostatní autori (členovia
riešiteľského kolektívu) si vzájomné vzťahy s touto osobou – účastníkom zmluvne vysporiadajú tak, aby účastník bol plne oprávnený s návrhom - dielom nakladať v intenciách týchto súťažných pod- mienok a následne v prípade, ak by bol tento návrh vyhodnotený ako úspešný aj uzavrieť zmluvu s vyhlasovateľom ako verejným obstarávateľom v postupe podľa § 81 písm. h) ZVO.
5. Vyhlasovateľ dáva do pozornosti, že od úspešného účastníka bude v priamom rokovacom konaní nadväzujúcom na ukončenú súťaž návrhov požadovať splnenie podmienok účasti týkajúcich sa osobného postavenia podľa § 32 ZVO, V tejto súvislosti viď čl. XII. bod 6. týchto súťažných podmie- nok.
V. KOMUNIKÁCIA
1. Komunikácia medzi vyhlasovateľmi a účastníkom sa uskutočňuje v slovenskom, českom alebo an- glickom jazyku výhradne prostredníctvom informačného systému Xxxxxxxxx.
2. V prípade potreby vysvetliť alebo objasniť údaje uvedené v Súťažných podmienkach a ich prílohách môže účastník požiadať o ich vysvetlenie prostredníctvom systému Xxxxxxxxx.
3. Všetky vysvetlenia a kladné vybavenia žiadostí o nápravu bude vyhlasovateľ uverejňovať vo svojom profile na webovej adrese: xxxxx://xxxxxxxxx.xxxxxxx.xxx/xx/xxxxxx/0000/xxxxxxx .
4. Vyhlasovateľ vyhlási túto súťaž návrhov zverejnením Oznámenia o súťaži návrhov vo Vestníku vere- jného obstarávania dostupnom na adrese: xxxxx://xxx.xxx.xxx.xx/xxxxxxx-000.xxxx.
5. Vyhlasovateľ bezodkladne po rozhodnutí poroty v prvom kole oznámi účastníkovi rozhodnutie poroty v hodnotení prvého kola a v druhom kole výsledok súťaže. Spraví tak písomne a priloží kópiu zápisnice zo zasadnutia poroty spolu s prílohami, a to elektronicky, prostredníctvom informačného systému Xxxxxxxxx.
6. Zverejnenie výsledku súťaže vykoná vyhlasovateľ odoslaním výsledku súťaže návrhov na zverejnenie do Vestníka verejného obstarávania. Vyhlasovateľ zároveň uverejní výsledok na svojom profile na adrese: xxxxx://xxxxxxxxx.xxxxxxx.xxx/xx/xxxxxx/0000/xxxxxxx .
7. Súťažné návrhy zaradené do hodnotenia poroty budú môcť byť po zverejnení výsledku súťaže návrhov zverejnené na výstave, na webe a prípadne i v tlačenej publikácii, podľa rozhodnutia vy- hlasovateľa.
IV. SCOPE OF THE PARTICIPANTS OF THE COMPETITION
1. This design competition is issued as a public competition for a number of anonymous participants not defined in advance.
2. A participant in the design competition shall not be the one:
a. who prepared the criteria for the selection of participants; who prepared the evaluation criteria of the submitted designs;
b. who is a member of the jury, alternate member of the jury, competition secretary, certifier of the competition designs or specialised expert called in by the jury;
c. who certified the competition conditions on behalf of the Slovak Chamber of Architects;
d. who is an employee of the announcer;
e. who is a connected party, partner, statutory body, employee or employer of persons ex- cluded from the participation in the design competition as per sections (a) to (d).
3. A participant may only be an entity with authorisation for the pursuit of a business representing the activity specified in Section 4 of Act no. 138/1992 Coll. on authorised architects and authorised civil engineers, as amended (hereinafter referred to as “AAA”), or according to the equivalent law applicable in the country in which the participant pursues their business. A participant is obliged to prove the fulfilment of this condition with a declaration on oath, the template of which forms the Annex no. 2 hereof.
4. In the event of participation of a team of authors (team of designers), the condition of professional qualification must be met by at least one member – participant, who shall be fully authorised by the other members of the team of designers for the submission and handling of the design. The other authors (members of the team of designers) shall settle their mutual relations with this per- son – participant contractually so that the tenderer is fully authorised to handle the design - work within the scope of these tender conditions and, subsequently, in case the design is evaluated as successful, to conclude the contract with the Announcer as the Contracting Authority in accordance with Section 81(h) of APP.
5. The Announcer draws attention to the fact that in the direct negotiation procedure following the completed design tender, it will require the successful tenderer to fulfil the conditions of participa- tion related to the personal status according to Section 32 of APP. In relation to this, see Article XII., section 6. of these tender conditions.
V. COMMUNICATION
1. Communication between the announcers and participant shall be carried out in the Slovak, Czech or English language solely with the use of the Xxxxxxxxx information system.
2. If it is necessary to explain or clarify the data specified in the Competition conditions and annexes thereof, the participant may request their explanation via the Xxxxxxxxx system.
3. All the explanations and positive processing of the requests for review shall be published by the announcer on its profile on the web page: xxxxx://xxxxxxxxx.xxxxxxx.xxx/xx/xxxxxx/0000/xxxxxxx
.
4. The announcer shall issue the call for this design competition by the publication of the Notice of design competition in the Journal of Public Procurement available at: xxxxx://xxx.xxx.xxx.xx/xxxx- nik-590.html.
5. Immediately after the decision of the jury in the 1st round, the Announcer shall notify the competi- tor of the jury’s decision regarding the 1st round’s evaluation and of the result of the competition in the 2nd round. This shall be done in writing, i.e. electronically, via the Xxxxxxxxx information system together with an enclosed copy of the minutes of the jury’s meeting with its annexes.
6. Publication of the competition result shall be carried out by the announcer by sending the de- sign competition result for publication to the Journal of Public Procurement. At the same time, the
announcer shall publish the result on its profile at: xxxxx://xxxxxxxxx.xxxxxxx.xxx/xx/xxxxxx/0000/ summary .
7. After the announcement of the design competition result, the competition designs included in the jury evaluation may be published at an exhibition, on the web and even in a printed publication, as per the announcer´s decision.
VI. | VYHOTOVENIE SÚŤAŽNéHO NÁVRHU | VI. | PREPARATION OF THE COMPETITION DESIGN |
1. 2. | Účastník v prvom kole predkladá súťažný návrh rozdelený do dvoch častí, pričom prvá časť návrhu obsahuje sprievodný dokument s údajmi o účastníkovi a autorovi, a druhá časť obsahuje samotný návrh účastníka s dôrazom na zachovanie anonymity. Súťažný návrh bude vyhotovený v slovenskom, prípadne českom alebo anglickom jazyku. Rozsah a forma: Súťažný návrh bude prezentovaný na 2 formátoch, každom s rozmermi 700 mm x 1 000 mm s orientáciou na výšku. Odporúčané rozloženie je k dispozícii ako súťažná pomôcka, „predloha súťažných panelov 1.kolo“. Rozsah a forma: Súťažný návrh bude prezentovaný na 6 formátoch, každom s rozmermi 700 mm x 1 000 mm s orientáciou na výšku. Odporúčané rozloženie je k dispozícii ako súťažná pomôcka, „predloha súťažných panelov 2.kolo“. Panely by mali obsahovať: – situáciu riešeného územia s 0.XX v mierke 1:300 – pôdorysy všetkých podlaží v mierke 1:300 – minimálne 4 rezopohľady v mierke 1:300 – pôdorysy všetkých podlaží a minimálne 2 rezopohľady v mierke 1:300 so zakreslením stavebných úprav (dostavované konštrukcie – červenou, búrané konštrukcie žltou, zachované konštrukcie čier- nou) – 4 vizualizácie: – 2 exteriérové – parčík so vstupom z Medenej, ľubovoľný dvor – 2 interiérové – jednoduchý výkaz plošných a priestorových bilancií navrhovaných objektov. Jeho predloha je k dis- pozícii ako súťažná pomôcka „predloha výkazu bilancii.xls“ – ďalšia prezentácia návrhu/konceptu/atmosféry podľa uváženia (text, skice, diagramy, detaily, vizualizácie, ...) Panely budú predložené ako jeden súbor PDF obsahujúci 6 požadovaných formátov s názvom „panely s navrhom.pdf“ s rozlíšením 300 DPI (bodov na palec). Veľkosť tohto súboru nesmie presiahnuť 40 MB. | Scope and form: The competition design will be presented in 5 to 6 formats, each with the dimensions of 700 mm x 1,000 mm with a horizontal orientation. The recommended arrangement is available as competition aid "model of the competition panels 2nd round". 4. Účastník doručí súťažný návrh v dvoch častiach (dokladová časť, grafická časť), elektronicky prostredníctvom informačného systému Xxxxxxxxx v lehote na predkladanie návrhov. Vyhlasovateľ účastníkom dôrazne odporúča ponechať dostatočnú časovú rezervu na elektronické odovzdanie prostredníctvom informačného systému Xxxxxxxxx (kontakt v prípade problémov x000 000 000 000, xxxxxxx@xxxxxxx.xxx).
5. Účastník môže predložený návrh doplniť, zmeniť alebo vziať späť do uplynutia lehoty na pred- kladanie návrhov.

4. The competitor shall deliver the competition design in two parts (document part, graphical part) electronically via the Xxxxxxxxx information system within the period for the submission of designs. IX. POROTA
Počet riadnych členov poroty je 5, hlasovacie kvórum je 5. Na zasadnutiach poroty sa zúčastňujú všetci riadni členovia a všetci náhradníci; náhradníci majú poradný hlas. Ak nie je prítomný riadny člen poroty, stáva sa náhradník riadnym členom s plnohodnotným hlasom. Porotcu nezávislého na vyhlasovateľovi môže nahradiť len náhradník nezávislý na vyhlaso- vateľovi. Porota má predsedu, ktorého si zvolila spomedzi riadnych členov na jej prvom zasadnutí.

X. HODNOTENIE PREDLOŽENÝCH NÁVRHOV
1. Súťažné návrhy, ktoré neboli vylúčené zo súťaže, budú hodnotené podľa kritéria: kvalita architektonického riešenia vo vzťahu k zadaniu.
2. Spôsob uplatnenia kritéria: Porota väčšinovým hlasovaním na základe diskusie pridelí každému návrhu poradie podľa hodnotenia návrhu vo vzťahu ku kritériu uvedenému v bode 1. Vyššie poradie patrí vždy návrhu, ktorý vo väčšej miere spĺňa požiadavky kritéria na hodnotenie návrhov. Víťazným návrhom súťaže návrhov sa stane návrh, ktorý sa umiestni na prvom (najvyššom) mieste v poradí hodnotenia návrhov.
3. Spôsob uplatnenia kritérií v 1. kole súťaže:
Porota na základe väčšinového hlasovania pridelí každému z návrhov body podľa kritéria v bode X.1. Vyšší počet bodov znamená lepšie hodnotenia návrhu, nižší počet bodov horšie hodnotenie návrhu. Do druhého kola postúpi päť návrhov s najvyšším počtom bodov. V prípade, že porota bude považovať počet hodnotených návrhov alebo ich kvalitu za nízku, môže počet návrhov do druhého kola znížiť najmenej na
IX. JURY
The number of full members of the jury is 5, and the voting quorum is 5. Meetings of the jury shall be attended by all the full members and all the alternate members; the alternate members have an advisory vote. If the full member of the jury is not present, the alternate member becomes the full member with a full vote. X. EVALUATION OF THE SUBMITTED DESIGNS
1. Tender designs which have not been excluded from competition shall be evaluated accord- ing to the criterion: quality of the architectural solution in relation to the assignment.
2. Application method of the criterion: By a majority vote based on a discussion, the jury shall assign a ranking to each design according to the evaluation of the design with regard to the criterion specified in section 1. A higher ranking always belongs to the design which to a larger extent fulfils the design evaluation criterion requirements. The winning design of the design competition shall become the one that ranks in first (the highest) place in the rankings of the designs.
3. Application method of the criteria in the 1st round of the tender:
Based on a majority vote, the jury shall assign points to each design according to the cri- terion in section X.1. A higher number of points means a better evaluation of the design; a lower number of points means a worse evaluation of the design. The five designs with the highest number of points shall qualify to the second round. In case the jury finds the num- ber of evaluated designs or their quality low, the number of designs in the second round
tri návrhy. Toto svoje rozhodnutie musí písomne zdôvodniť v zápisnici z hodnotiaceho zasadnutia v prvom kole súťaže.
4. Spôsob uplatnenia kritérií v 2. kole súťaže:
Porota na základe väčšinového hlasovania pridelí každému z návrhov body podľa kritéria v bode X.1. Vyšší počet bodov znamená lepšie hodnotenia návrhu, nižší počet bodov horšie hodnotenie návrhu. Podľa počtu bodov sa stanoví poradie, kde
sa víťazným návrhom stáva taký, ktorý získa najvyšší počet bodov. Návrhy, ktoré dos- tanú rovnaký počet bodov, sa umiestnia na rovnakom mieste.
5. Porota je uznášaniaschopná, ak je prítomný plný počet hlasovacieho kvóra (5). Poro- ta rozhoduje nadpolovičnou väčšinou hlasov kvóra.
6. Výsledok súťaže je pre vyhlasovateľa záväzný.
7. Zákazka na poskytnutie služieb bude zadaná účastníkovi, ktorého návrh vyhodnotila porota ako víťazný.
XI. CENY A ODMENY
1. V súťaži budú udelené podľa poradia návrhov tieto ceny: 1. cena: 25 000 €
2. cena: 15 000 €
3. cena: 10 000 €
1. odmena: 5 000 €
2. odmena: 5 000 €
Vyhlasovateľ uvádza, že 1. a 2. odmenu bude udeľovať iba v prípade, ak do druhého kola postúpia viac ako traja účastníci, t. zn. štyria alebo piati účastníci.
Porota si vyhradzuje právo rozhodnúť o prípadnom neudelení niektorej z cien a odmien, prípadne o inom rozdelení cien a odmien. Takéto rozhodnutie musí písomne zdôvodniť v zápisnici z hodnotiaceho zasadnutia.
XII. PRIAME ROKOVACIE KONANIE – ZADANIE NADVÄZUJÚCEJ ZÁKAZKY
1. Po súťaži návrhov zrealizuje jeden z vyhlasovateľov samostatne alebo viacerí z vyhlaso- vateľov spoločne priame rokovacie konanie v zmysle ustanovení § 81 písm. h) ZVO.
2. Vyhlasovateľ vyzve na rokovanie účastníka, ktorého návrh vyhodnotila porota ako víťazný.
3. Predmetom zákazky na poskytnutie služieb bude najmä:
a. vypracovanie architektonickej štúdie;
b. vypracovanie dokumentácie pre vydanie územného rozhodnutia (v súlade s vyhlášk- ou č. 453/2000 Z. z., ktorou sa vykonávajú niektoré ustanovenia stavebného zákona
– ďalej „VSZ“) a stavebný zámer verejnej práce (v súlade s vyhláškou č. 83/2008 Z. z., ktorou sa vykonáva zákon č. 254/1998 Z. z. o verejných prácach);
c. vypracovanie dokumentácie pre vydanie stavebného povolenia (v súlade s VSZ);
d. vypracovanie dokumentácie pre realizáciu stavby (v súlade s rozsahom prác podľa sadzobníka UNIKA);
e. vykonanie odborného autorského dohľadu (v súlade s rozsahom prác podľa sadzob- níka UNIKA);
f. vykonanie inžinierskej činnosti súvisiacej s vyššie uvedenými službami.
4. Výsledkom priameho rokovacieho konania bude uzatvorenie Zmluvy o dielo podľa zák. č. 513/1991 Zb. Obchodného zákonníka v zn. n. p.
5. Vyhlasovateľ nie je oprávnený uzatvoriť Zmluvu o dielo ako výsledok priameho rokovacieho konania s účastníkom, ktorý má povinnosť zapisovať sa do registra partnerov verejného sek- tora v zmysle ustanovení zákona č. 315/2016 Z. z. o registri partnerov verejného sektora v zn.
n. p. a ktorý nie je zapísaný v tomto registri, alebo ktorého subdodávatelia alebo subdodá- vatelia podľa osobitného predpisu, ktorí majú povinnosť zapisovať sa do registra partnerov verejného sektora, nie sú zapísaní v tomto registri.
6. Vyhlasovateľ stanovuje nasledujúce podmienky účasti v priamom rokovacom konaní, ktoré musí účastník vyzvaný na rokovanie spĺňať, s poukazom na § 32 ZVO:
a) nebol on, ani jeho štatutárny orgán, ani člen štatutárneho orgánu, ani člen dozorného

4. Application method of the criteria in the 2nd round of the competition:
Based on the majority vote the jury shall assign points to each design according to the criterion in section X.1. A higher number of points means a better evaluation of the design; a lower number of points means a worse evaluation of the design. The ranking shall be determined by the number of points, and the winning design is the one with the highest number of points. Designs that achieve the same number of points shall rank in the same place.
5. The jury has a quorum if the full number of voting quorum (5) is present. The jury decides by a majority of quorum votes.
6. The tender result shall be binding on the Announcer.
7. The service contract will be awarded to the tenderer whose proposal was judged by the jury to be the winner.
XI. PRIZES AND REMUNERATION
1. The following prizes will be awarded in the competition based on the order of the designs:
1st prize: 25 000 €
2nd prize: 15 000 €
3rd prize: 10 000 €
1st remuneration: 5 000 €
2nd remuneration: 5 000 €
The announcer declares that the 1st and 2nd remuneration will only be awarded if more than three participants qualify into the second round, i.e. four or five participants.
The jury reserves the right to decide on not awarding any of the prizes and remunerations or on another division of the prizes and remuneration. Such a decision must be justified in writing in the minutes of the evaluation meeting.
XII. DIRECT NEGOTIATION PROCEDURE – ASSIGNMENT OF THE FOLLOW UP CON- TRACT
1. After the design competition, one of the announcers individually or more announcers jointly shall initiate the direct negotiation procedure in compliance with the provisions of Section 81(h) of APP.
2. The announcer shall invite to the negotiation the participant whose design was evaluated by the jury as the winning one.
3. The subject of the contract for the provision of services shall be:
a. elaboration of the architectural study;
b. elaboration of the documentation for the issue of planning permission (in compli- ance with the Decree no. 453/2000 Coll. implementing certain provisions of the Building Act – hereinafter referred to as "DBA") and the construction plan of the public works (in compliance with the Decree no. 83/2008 Coll. implementing the Act no. 254/1998 Coll. on public works);
c. elaboration of the documentation for the issue of a building permit (in compliance with DBA);
d. elaboration of the documentation for the construction implementation (in compli- ance with the scope of works according to the UNIKA schedule);
e. performance of specialised authorial supervision (in compliance with the scope of works according to the UNIKA schedule);
f. performance of engineering activity related to the above specified services.
4. The result of the direct negotiation procedure shall be the conclusion of the Contract of Works under Act no. 513/1991 Coll. Commercial Code, as amended.
5. the announcer is not obliged to conclude the Contract of Works as a result of the direct ne- gotiation procedure with the participant who is obliged to register into the Register of Public

b) nemá evidované nedoplatky na poistnom na sociálne poistenie a zdravotná poisťovňa neeviduje voči nemu pohľadávky po splatnosti podľa osobitných predpisov v Slovenskej republike alebo v štáte sídla, miesta podnikania alebo obvyklého pobytu;
c) nemá evidované daňové nedoplatky voči daňovému úradu a colnému úradu podľa osobit- ných predpisov v Slovenskej republike alebo v štáte sídla, miesta podnikania alebo obvyklého pobytu;
d) nebol na jeho majetok vyhlásený konkurz, nie je v reštrukturalizácii, nie je v likvidácii,
ani nebolo proti nemu zastavené konkurzné konanie pre nedostatok majetku alebo zrušený konkurz pre nedostatok majetku;
e) je oprávnený dodávať tovar, uskutočňovať stavebné práce alebo poskytovať službu;
f) nemá uložený zákaz účasti vo verejnom obstarávaní potvrdený konečným rozhodnutím v Slovenskej republike alebo v štáte sídla, miesta podnikania alebo obvyklého pobytu;
g) nedopustil sa v predchádzajúcich troch rokoch od vyhlásenia alebo preukázateľného začatia verejného obstarávania závažného porušenia povinností v oblasti ochrany životného prostredia, sociálneho práva alebo pracovného práva podľa osobitných predpisov, za ktoré mu bola právoplatne uložená sankcia, ktoré dokáže verejný obstarávateľ a obstarávateľ preukázať;
h) nedopustil sa v predchádzajúcich troch rokoch od vyhlásenia alebo preukázateľného začatia verejného obstarávania závažného porušenia profesijných povinností, ktoré dokáže verejný obstarávateľ a obstarávateľ preukázať.
XIII. ăALŠIE INFORMÁCIE
1. Všetky náklady spojené s prípravou a predložením návrhu znáša účastník bez nároku na finančnú náhradu voči vyhlasovateľovi.
2. Vyhlasovateľ sa zaväzuje rešpektovať autorské práva autorov návrhov v súlade so zák. č. 185/2015 Z. z. Autorský zákon v zn. n. p. (ďalej „AZ“).
3. Účastník podaním súťažného návrhu udeľuje vyhlasovateľovi výhradný súhlas s použitím diela predstavujúceho súťažný návrh pre potreby súťaže, prezentačné účely súťaže návrhov formou zverejnenia na výstave, na internetovej stránke a v tlačenej publikácii, všetko v súlade s § 91 AZ a príslušnými ustanoveniami ZVO.
4. Vyhlasovateľ je povinný zachovávať mlčanlivosť o informáciách označených ako dôverné, ktoré mu účastník poskytol; na tento účel účastník označí, ktoré skutočnosti považuje za dôverné, a ktorými môžu byť v tomto postupe výhradne iba obchodné tajomstvo, technické riešenia, predlohy, návody, výkresy, projektové dokumentácie, modely, spôsob výpočtu jed- notkových cien. Tým nie sú dotknuté ustanovenia ZVO ukladajúce vyhlasovateľovi oznamovať či zasielať Úradu pre verejné obstarávanie dokumenty a iné oznámenia, zverejňovať doku- menty a tiež povinnosti zverejňovania zmlúv podľa zákona č. 211/2000 Z. z. o slobodnom prístupe k informáciám v zn. n. p.
5. Vyhlasovateľ oboznamuje účastníkov, že pre potreby tejto súťaže disponuje súhlasom od poskytovateľa licencie: Hlavné mesto Slovenskej republiky Bratislava, na požitie nasledujúcich mapových údajov:
a) výstupy mapy mesta vo forme 4 mapových listov v mierke 1:500 vo vektorovom formáte DXF;
b) 1 mapový list ortofotomapy v rastrovom formáte JPG (6250 x 5000 bodov).
Účastníci smú uvedené mapové údaje použiť výlučne na účely vypracovania súťažného návrhu.
6. Vyhlásenú súťaž je možné zrušiť len zo závažných dôvodov. Zrušenie súťaže bude oznámené rovnakým spôsobom, akým bola súťaž vyhlásená.

6. With reference to Section 32 of APP, the announcer specifies the following conditions of participa- tion in the direct negotiation procedure that must be met by the participant invited to the negotia- tion:
a) neither the participant, nor its statutory body, member of the statutory body, member of the su- pervisory body, nor its authorised representative has been convicted of the crime of corruption, the crime of impairing the European Communities´ financial interests, the crime of money laundering, a criminal group, the otfence of establishment, abetting or supporting of terrorist group and other forms of participation in terrorism, the crime of human trafficking, an otfence the facts of which relate to business or an otfence of contrivance during public procurement and public auction;
b) it does not have any recorded outstanding payment of social security contributions and the health insurance company does not register any past due receivables against it under special regu- lations in the Slovak Republic or in the country of its registered office, place of business or habitual residence;
c) it does not have any recorded outstanding taxes payable to the Tax Office and Customs Office under special regulations in the Slovak Republic or in the country of its registered office, place of business or habitual residence;
d) its property has not been declared bankrupt, it is not under restructuring, nor in liquidation, nor the insolvency proceeding was stopped due to the lack of assets or the bankruptcy was cancelled due to the lack of assets;
e) it is entitled to supply goods, perform construction works or provide services;
f) it is not prohibited from participating in public procurement approved by the final decision in the Slovak Republic or in the country of its registered seat, place of business or habitual residence;
g) in the three preceding years from the announcement or provable initiation of public procurement, it has not committed serious breach of its obligations in the field of environmental protection, social law or labour law according to special regulations, for which it was sanctioned and which can be proven by the public contracting authority and contracting authority;
h) in the three preceding years from the announcement or provable initiation of public procurement, it has not committed serious breach of its professional obligations which can be proven by the pub- lic contracting authority and contracting authority.
XIII. ADDITIONAL INFORMATION
1. All the costs related to the preparation and submission of the design shall be borne by the partici- pant without requesting financial compensation from the announcer.
2. The announcer undertakes to respect the copyright of the design authors in compliance with Act no. 185/2015 Coll. Copyright Act, as amended (hereinafter referred to as the "CA").
3. By submission of the design, the participant grants the announcer an exclusive consent to use the piece of work representing the competition design for the purposes of the competition, presentation purposes of the design competition by its publishing at an exhibition, Internet page and in a print- ed publication, all in compliance with Section 91 of the CA and the applicable provisions of APP.
4. The announcer is obliged to maintain confidentiality of the information marked as confidential that was provided by the participant; for this purpose the participant shall mark the facts that it con- siders confidential and which may solely be a trade secret, technical solutions, templates, manuals, drawings, project documentations, models, calculation methods of unit prices. This does not atfect the provisions of APP obliging the announcer to notify or send to the Office for Public Procurement documents and other notices, publish documents and the obligation to publish contracts according to Act no. 211/2000 Coll. on free access to information, as amended.
5. The announcer informs the participants that, for the purposes of this competition, it has the consent of the licence provider: Capital City of the Slovak Republic Bratislava, for the use of the following map data:
a) city map outputs in the form of 4 map sheets in the scale of 1:500 in vector format DXF;
b) 1 map sheet of the ortophotomap in raster format JPG (6250 x 5000 points).
Participants may use the specified map data solely for the purpose of competition design prepara- tion.
6. The competition may only be cancelled for serious reasons. The cancellation of the competition shall be announced in the same way as the competition was announced.
