1. KAPITOLA VŠEOBECNÉ USTANOVENIA

Pravidlo 5bis Pokračovanie v konaní

(c) Bez ohľadu na písmeno (b), ak bolo vyznačené po- kračovanie v konaní podľa pravidla 5bis, musí byť li- cencia zapísaná do medzinárodného registra v deň uplynutia lehoty stanovenej v odseku (€).

5. KAPITOLA NÁSLEDNÉ VYZNAČENIA; ZMENY

(1) Žiadosť

(a) Ak prihlasovateľ alebo majiteľ zmeškal niektorú z le- hôt stanovených alebo uvedených v pravidlách 11(€) a (3), €0bis(€), €4(5)(b), €6(€), 34(3)(c)(iii) a 39(1), bude medzinárodný úrad napriek tomu pokračovať v konaní o medzinárodnej prihláške, v následnom vyznačení, v platbe alebo príslušnej Biadosti, ak:

(i) Biadosť o pokračovanie v konaní, podpísaná pri- hlasovateľom alebo majiteľom, je predloBená me- dzinárodnému úradu na úradnom formulári a

(ii) Biadosť je prijatá, poplatok podľa sadzobníka po- platkov zaplatený a spolu so Biadosťou sú splne- né všetky poBiadavky, ktorých sa zmeškaná leho- ta týka, a to do dvoch mesiacov odo dňa uplynutia tejto lehoty.

(b) Žiadosť, ktorá nie je v súlade s bodmi (i) a (ii) písme- na (a), sa nebude za takú povaBovať a prihlasovateľ alebo majiteľ bude o tom informovaný.

Medzinárodný úrad vyznačí v medzinárodnom regis- tri pokračovanie v konaní a informuje o tom prihlaso- vateľa alebo majiteľa.

(1) Poplatky

(a) Medzinárodný zápis sa obnoví po zaplatení poplat- kov, najneskôr v deň, keU sa má vykonať obnova me- dzinárodného zápisu, a to

(a) Ak si majiteľ neBelá obnoviť medzinárodný zápis pre vyznačenú zmluvnú stranu, pre ktorú nebolo do me- dzinárodného registra zapísané Biadne odmietnutie podľa pravidla 18ter vo vzťahu ku všetkým dotknu- tým výrobkom a sluBbám, platba poBadovaných po- platkov sa doplní vyhlásením majiteľa o tom, Be ob- nova medzinárodného zápisu sa nemá do medzinárodného registra zapisovať vo vzťahu k tejto zmluvnej strane.

(b) Ak si majiteľ Belá obnoviť medzinárodný zápis pre vyznačenú zmluvnú stranu bez ohľadu na skutoč- nosť, Be pre túto zmluvnú stranu bolo zapísané od- mietnutie podľa pravidla 18ter vo vzťahu ku všet- kým dotknutým výrobkom a sluBbám, platba poBadovaných poplatkov vrátane prípadných dopl- ňujúcich alebo individuálnych poplatkov týkajúcich sa tejto zmluvnej strany sa doplní vyhlásením maji- teľa, Be obnova medzinárodného zápisu sa má zapí- sať do medzinárodného registra vo vzťahu k tejto zmluvnej strane.

(c) Medzinárodný zápis sa nesmie obnoviť voči tej zmluvnej strane, vo vzťahu ku ktorej sa zapísala ne- platnosť zápisu pre všetky výrobky a sluBby podľa pravidla 19(€) alebo sa zaznamenalo vzdanie sa zá- pisu podľa pravidla €7(1)(a). Medzinárodný zápis sa nesmie obnoviť voči vyznačenej zmluvnej strane pre tie výrobky a sluBby, pre ktoré bola vyznačená ne- platnosť medzinárodného zápisu na území zmluvnej

nie sú vo vyhlásení uvedené, ibaBe by majiteľ súčas- ne so zaplatením poBadovaných poplatkov vyhlásil, Be medzinárodný zápis sa má obnoviť aj pre tieto vý- robky a sluBby.

(e) Skutočnosť, Be sa medzinárodný zápis neobnovil podľa písmena (d) pre všetky dotknuté výrobky a sluBby, sa nemôBe povaBovať za zmenu podľa člán- ku 7(€) dohody alebo článku 7(€) protokolu. Skutoč- nosť, Be medzinárodný zápis nebol obnovený pre všetky vyznačené zmluvné strany, sa nemôBe povaBovať za zmenu podľa článku 7(€) dohody alebo podľa článku 7(€) protokolu.

(4) Oznámenie v prípade neobnovenia zápisu

(a) Ak medzinárodný zápis nie je obnovený, medziná- rodný úrad bude o tom informovať majiteľa, zástup- cu, ak existuje, a úrady všetkých zmluvných strán vyznačených v tomto medzinárodnom zápise.

Detαils Conзerning Renewαl

(a) The international registration shall be renewed upon payment, at the latest on the date on which the renewal of the international registration is due, of

(a) Where the holder does not wish to renew the international registration in respect of a designated Contracting Party for which no statement of refusal under Rule 18ter, in respect of all the goods and services concerned, is recorded in the International Register, payment of the required fees shall be accompanied by a statement by the holder that the renewal of the international registration is not to be recorded in the International Register in respect of that Contracting Party.

(b) Where the holder wishes to renew the international registration in respect of a designated Contracting Party notwithstanding the fact that a statement of refusal under Rule 18ter is recorded in the International Register for that Contracting Party in respect of all the goods and services concerned, payment of the required fees, including the complementary fee or individual fee, as the case may be, for that Contracting Party, shall be accompanied by a statement by the holder that the renewal of the international registration is to be recorded in the International Register in respect of that Contracting Party.

(c) The international registration shall not be renewed in respect of any designated Contracting Party in respect of which an invalidation has been recorded for all goods and services under Rule 19(€) or in respect of which a renunciation has been recorded under Rule €7(1)(a). The international registration shall not be renewed in respect of any designated Contracting Party for those goods and services in respect of which an invalidation of the effects of the

accompanied by a statement by the holder that the international registration is to be renewed also for those goods and services.

(e) The fact that the international registration is not renewed under subparagraph (d) in respect of all the goods and services concerned, shall not be considered to constitute a change for the purposes of Article 7(€) of the Agreement or Article 7(€) of the Protocol.
