Bekendtgørelse af aftale af 26. august 2019 med Ukraine om arbejdstilladelse til familiemedlemmer til diplomater
Ved udveksling af noter dateret hhv. den 31. januar 2019 og 19. juni 2019 i Kiev er der indgået en aftale med Ukraine om arbejdstilladelse til familiemedlemmer til diplomater.

NOTE VERBALE VERBALNOTE
The Royal Danish Embassy in Kiev presents its compliments to the Ministry of Foreign Affairs of Ukraine and has the honour to propose that the employment of family members of employees of diplomatic representations and consular posts of the Kingdom of Denmark to Ukraine and of Ukraine to the Kingdom of Denmark be regulated on the basis of reciprocity in accordance with the provisions of this arrangement.
Den danske ambassade i Kiev sender sine ærbødigste xxxxxxx til Udenrigsministeriet i Ukraine og har den ære at foreslå, at beskæftigelse for familiemedlemmer til medlemmer af det diplomatiske og konsulære personale ved diplomatiske og konsulære repræsentationer fra henholdsvis Danmark til Ukraine samt fra Ukraine til Danmark fastlægges efter reciprocitetsprincippet i overensstemmelse med denne aftales indhold.
1. Conditions 1. Betingelser
1.1 Family members who wish to continue a professional career or who wish to provide services to the community will be exempted, on a reciprocal basis, from the obligation of applying for authorisation to engage in employment.
1.1 Familiemedlemmer, der ønsker at fortsætte en arbejdsmæssig karriere, eller som ønsker at yde bidrag til samfundet, vil på gensidig basis blive undtaget fra forpligtelsen om at ansøge om arbejdstilladelse.

(a) "employees of the sending State" means the head and the members of the diplomatic, consular, administrative, technical and service staff of diplomatic representation or consular post of the sending State who are accredited in their capacity by the receiving State, and who are not nationals or permanent residents of the receiving State;
(b) "a member of the family" means a person who forms part of the household, accompanying an employee of the sending State, and who has been notified to and accepted as such by the receiving State;
(c) "Diplomatic Convention" means the Vienna Convention on Diplomatic Relations of 1961;
(d) "Consular Convention" means the Vienna Convention on Consular Relations of 1963;

1.3 A family member can engage in employment from the time of his or her accreditation in the receiving State in connection with the arrival of the employee of the sending State to take up his or her post.
1.3 Familiemedlemmet kan engagere sig i beskæftigelse fra og med vedkommendes akkreditering i modtagerstaten i forbindelse med ankomsten af udsenderstatens ansatte og dennes tiltrædelse af sin stilling;

2. Immunity from Civil and Administrative Jurisdiction 2. Immunitet over for civilretlig og administrativ

2.1 In the case of a family member enjoying immunity from the civil and administrative jurisdiction of the receiving State in accordance with the Diplomatic Convention, the Consular Convention or any other agreement which may apply between the Governments, such a family member who engages in professional services for remuneration outside the diplomatic representation or consular post of the sending State will by virtue of Article 31.1(c) of the Diplomatic Convention automatically not enjoy immunity from the civil and administrative jurisdiction of the receiving State.
2.1 I tilfælde af at familiemedlemmet nyder immunitet over for den civile og administrative jurisdiktion i modtagerstaten i overensstemmelse med den Diplomatiske konvention, den Konsulære konvention eller enhver anden aftale, der kan finde anvendelse mellem regeringerne, vil et sådant familiemedlem, der mod vederlag engagerer sig i arbejdsmæssige ydelser udenfor udsenderstatens diplomatiske eller konsulære repræsentation, efter Artikel 31.1(c) i den Diplomatiske konvention automatisk ikke længere nyde immunitet over for civil eller administrativ jurisdiktion i modtagerstaten.
2.2 In such a case, the sending State will be requested to consider waiving the immunity from execution of judgment against such a family member.
2.2 I et sådant tilfælde vil udsenderstaten blive anmodet om at overveje at ophæve det pågældende familiemedlems strafferetslige immunitet.
3. Immunity from Criminal Jurisdiction 3. Immunitet over for strafferetslig jurisdiktion
3.1 In the case of a family member enjoying immunity from the criminal jurisdiction of the receiving State in accordance with the Diplomatic Convention, the Consular Convention or any other agreement which may apply between the Governments:
(a) The sending State will be requested to consider waiving the immunity of the family member from the criminal jurisdiction of the receiving State in respect of any act or omission arising from the employment; and
(b) A waiver of immunity from criminal jurisdiction will not be construed as extending to immunity from execution of the sentence, for which a separate waiver will be required.
3.1 I tilfælde af at familiemedlemmet nyder immunitet over for strafferetslig jurisdiktion i modtagerstaten i overensstemmelse med den Diplomatiske konvention, den Konsulære konvention eller enhver anden aftale, der kan finde anvendelse mellem regeringerne, vil
(a) udsenderstaten blive anmodet om at overveje at ophæve familiemedlemmets immunitet over for strafferetslig jurisdiktion i modtagerstaten med henblik på enhver handling eller undladelse, der måtte finde sted i forbindelse med arbejdsbeskæftigelsen; og
(b) en ophævelse af immunitet over for strafferetslig jurisdiktion ikke blive fortolket til også at omfatte immunitet over for strafafsoning, for hvilken en særskilt dispensation vil blive påkrævet.
4. Taxation and Social Security Regimes 4. Beskatning og sociale sikringsordninger
4.1 A family member will be subject to the taxation and social security regimes applicable in the receiving State for all matters connected with the employment in the receiving State, in so far as this does not conflict with other international instruments.
4.1 Familiemedlemmet vil blive genstand for beskatning og sociale sikringsordninger, der finder anvendelse i modtagerstaten for alle de anliggender, der vedrører arbejdsbeskæftigelsen i modtagerstaten, for så vidt at dette ikke strider mod andre internationale instrumenter.
5. Repatriation of Funds 5. Hjemtagelse af midler
5.1 Family members entered into employment will be allowed to repatriate their remuneration for such employment out of the territory of the receiving State in accordance with the conditions laid down for foreign workers in the regulations of the receiving State and subject to the taxation and social security regimes applicable in the receiving State.
5.1 For familiemedlemmer, der har engageret sig i arbejdsbeskæftigelse, vil det være tilladt at hjemtage vederlag for en sådan beskæftigelse fra modtagerstatens territorium i overensstemmelse med de betingelser for udenlandske arbejdstagere, som er fastlagt i modtagerstatens lovgivning, og de pågældende vil ligeledes være genstand for beskatning og sociale sikringsordninger, der finder anvendelse i modtagerstaten.

7. Entry and termination 7. Ikrafttrædelse og opsigelse
7.1 If the above conditions are acceptable for the Government of Ukraine, the Danish Side proposes that this note and the positive note in reply of the Ukrainian Side constitute the Agreement (in form of the exchange of notes) between the Government of the Kingdom of Denmark and the Cabinet of Ministers of Ukraine on paid employment of members of the family of employees of diplomatic missions and consular posts, which shall enter into force on the date of receipt by the Parties through diplomatic channels of the last written notification on the fulfilment of their internal procedures, necessary for this Agreement to enter into force, and remain in force until terminated by any of the two States with six (6) months written notice.
7.1 Såfremt de ovenstående betingelser kan godkendes af Ukraines regering, foreslår den danske side at denne bekendtgørelse samt den bekræftende bekendtgørelse fra den ukrainske side udgør Aftalen (i form af denne noteudveksling) mellem Kongeriget Danmarks regering og Ukraines ministerkabinet om den lønnede beskæftigelse af familiemedlemmer til det ansatte personale ved diplomatiske repræsentationer og konsulære repræsentationer, som skal træde i kraft på den dato, hvor parterne gennem diplomatiske kanaler modtager den sidste skriftlige meddelelse om afslutningen af de respektive interne procedurer, der er nødvendige for aftalens ikrafttræden. Aftalen forbliver i kraft indtil den ved skriftlig meddelelse og med seks (6) måneders varsel opsiges af en af de to stater.

The Ministry of Foreign Affairs of Ukraine also has the honour to confirm that these provisions are acceptable to the Government of Ukraine and that the Note of the Royal Danish Embassy in Kyiv No. 14/2019 of 31 January 2019 and this Note in reply constitute the Agreement (in form of the exchange of notes) between the Cabinet of Ministers of Ukraine and the Government of the Kingdom of Denmark on paid employment of members of the family of employees of diplomatic missions and consular posts, which shall enter into force on the date of receipt by the Parties through diplomatic channels of the last written notification on the fulfilment of their internal procedures, necessary for this Agreement to enter into force.
Ukraines Udenrigsministerium har ligeledes den ære at bekræfte, at disse vilkår kan tiltrædes af Ukraines regering, og at den Kongelige Danske Ambassade i Kievs bekendtgørelse nr. 14/2019 af 31. januar 2019 samt denne svarbekendtgørelse udgør Aftalen (i form af denne noteudveksling) mellem Ukraines ministerkabinet og Kongerigets Danmarks regering vedrørende lønnet beskæftigelse af familiemedlemmer til det ansatte personale ved diplomatiske samt konsulære repræsentationer, som skal træde i kraft på den dato, hvor parterne gennem diplomatiske kanaler modtager den sidste skriftlige meddelelse om afslutningen af de respektive interne procedurer, der er nødvendige for aftalens ikrafttræden.
