FINANCING FOR YOUR VEHICLE. This LIMITED WARRANTY is a Product Warranty and is not insurance.
This LIMITED WARRANTY is between the Customer (“YOU”, “YOUR”) named above and the Issuing Dealer (“WE, US, or OUR”) identified above for the THEFT DETERRENT SYSTEM identified above. This is not a service contract. This LIMITED WARRANTY is not issued by the manufacturer or wholesale company marketing the product. This LIMITED WARRANTY will not be honored by such manufacturer or wholesale company.
The ADMINISTRATOR of this LIMITED WARRANTY is Mechanical Breakdown Protection, Inc., at 000 XX Xxxxxxxx,
Xxx’x Summit, MO 64086. In the states of Florida (FL license # 60111), MBP Network, Inc. 000 XX Xxxxxxxx, Xxx’x Xxxxxx, XX 00000, is the ADMINISTRATOR. The telephone number is (000) 000-0000. The ADMINISTRATOR’S hours of operations are Monday through Friday 7 A.M. to 6 P.M. CST.
This LIMITED WARRANTY is not subject to state insurance laws but is subject to state law concerning warranties. There is no warranty, written or spoken, that extends beyond the description herein. This LIMITED WARRANTY gives YOU specific legal rights, and YOU may also have other rights which vary from state to state.
YOU should read this LIMITED WARRANTY carefully. It contains all of the information regarding coverage under this LIMITED WARRANTY. There is no other agreement between the OBLIGOR and YOU regarding this LIMITED WARRANTY coverage.
YOU acknowledge that YOU have not relied upon the statements or promises of any person unless expressly stated in this LIMITED WARRANTY. By signing below, YOU acknowledge that YOU received this LIMITED WARRANTY at no extra charge and YOU have read and understand the: Terms and Conditions; Exclusions from Coverage; and Other Items of Importance of this LIMITED WARRANTY. Furthermore, by signing below, YOU and WE affirm that the information contained on this page is accurate and complete.

Terms and Conditions
This LIMITED WARRANTY certifies that the VEHICLE described on the front page has had OUR THEFT DETERRENT SYSTEM professionally installed or applied.
Subject to the Terms and Conditions of this LIMITED WARRANTY, itemized herein, if the VEHICLE is still owned by YOU and the VEHICLE has been stolen and not recovered within thirty (30) days, or stolen and deemed a constructive total loss due to theft by YOUR primary insurance carrier, and payment has been made by YOUR primary insurance carrier to YOU or YOUR lienholder on YOUR behalf following the theft, YOU are entitled to provisions for BENEFIT payment. As a condition precedent to the obligations to provide for the payment of the BENEFIT, YOU shall have complied with all Terms and Conditions of this LIMITED WARRANTY.
Definitions
ACTUAL CASH VALUE (ACV): The retail value of the VEHICLE, on the Date of Loss, as listed in the National Automobile Dealers Association (NADA) Used Car Guide. If the retail value of the VEHICLE is not available in the NADA Used Car Guide, then an equivalent national or regional guide for the territory in which the VEHICLE is principally garaged will be used. For a VEHICLE which has no retail value available, or is located in territories where NADA or an equivalent national or regional guide is not customarily used, ACV will be determined using the best information available to the ADMINISTRATOR, which accurately reflects the retail value of YOUR VEHICLE and is customarily used as the basis for establishing ACV for the VEHICLE in the territory of the VEHICLE location.
BENEFIT: The total amount payable under this LIMITED WARRANTY as identified on the first page of this LIMITED WARRANTY.
INSURER: This LIMITED WARRANTY is not an insurance policy; however the OBLIGOR’S performance under this LIMITED WARRANTY is insured by a policy issued by American Bankers Insurance Company. If a covered claim is not paid within 60 days after YOU have filed a claim with US, YOU may file a claim directly with American Bankers Insurance Company of Florida, 00000 Xxxxx Xxxxx Xxxxx, Xxxxx, XX 00000. Please call (000) 000-0000 for instructions.
LIMITED WARRANTY TERM: The period during which coverage applies as shown on the first page of this LIMITED WARRANTY, coverage ends if the VEHICLE is declared a total loss.
OBLIGOR: The ISSUING DEALER identified on the first page that is obligated to perform under this LIMITED WARRANTY.
POLICE: The Local, State, or Federal Law Enforcement Agency having jurisdiction over YOUR VEHICLE’S theft.
THEFT DETERRENT SYSTEM: Glass etching or Body Panel Labels containing identification numbers and Window Warning Labels applied to the VEHICLE designed to deter theft.
VEHICLE: The VEHICLE identified by VIN on the first page of this LIMITED WARRANTY.
WE, US and OUR: The Issuing Dealer identified on the first page of this LIMITED WARRANTY. YOU and YOUR: Means the Customer identified on the first page of this LIMITED WARRANTY.
YOUR Requirements
1. It is an absolute condition of coverage that YOU purchase and maintain automobile physical damage coverage on the VEHICLE in an amount equal to the ACTUAL CASH VALUE of the VEHICLE for the full term of this LIMITED WARRANTY.
2. YOU must have a comprehensive theft insurance policy on the described VEHICLE in effect at the time of the theft.
If YOU fail to perform or violate any of the above Requirements this LIMITED WARRANTY shall be null and void.
Issuing Dealer Requirements
1. The THEFT DETERRENT SYSTEM must be properly and professionally applied to, or installed on YOUR VEHICLE in order for coverage to apply.
Additional Benefits
$1,000 Trip Interruption Benefit: provides that if the VEHICLE is stolen and a valid theft claim is covered by this LIMITED WARRANTY when YOU are traveling more than two hundred (200) miles from your permanent residence, YOU will be reimbursed up to one hundred seventy-five dollars ($175) per day for a maximum of six (6) days for meals (licensed restaurant only) and lodging (licensed hotel or motel only) expenses incurred.
$1,000 Travel Benefit: provides that if the VEHICLE is stolen and a valid theft claim is covered by this LIMITED WARRANTY when YOU are traveling more than five hundred (500) miles from YOUR permanent residence YOU will be reimbursed up to one thousand dollars ($1,000.00) for airfare for YOU and YOUR immediate family to return to YOUR primary residence.
$500 Substitute Transportation Benefit: provides that if the VEHICLE is stolen and a valid theft claim is covered by this LIMITED WARRANTY YOU will be reimbursed for substitute transportation expenses that are incurred in excess of the daily reimbursement limits paid by YOUR primary insurance policy, subject to a twenty dollar ($20) per day limit with a maximum benefit of five hundred dollars ($500). If YOUR primary insurance policy does not provide for substitute transportation expenses this benefit does not apply.
What to do in the event of a Theft
YOUR responsibilities
1. YOU must report the theft of YOUR VEHICLE to the POLICE within twenty-four (24) hours and YOU must contact and notify US within thirty (30) working days, YOU can contact US at (000) 000-0000.
How to make a Claim
In order to make a claim under this LIMITED WARRANTY, YOU must forward legible copies of the following documents to US within sixty (60) days of the primary insurance company settlement. All documents must be completely legible, otherwise the BENEFIT will be suspended until legible copies can be obtained and submitted:
1. YOU must provide a copy of this LIMITED WARRANTY and a POLICE report.
2. YOU must provide a copy of YOUR insurance settlement check, declaration page, and proof of loss valuation worksheet.
3. YOU must provide a copy of the original buyer’s order for the vehicle stating the purchase price along with the factory options and accessories affixed thereto at the time of delivery.
4. YOU must provide detail itemized receipts for any expenses provided for under the Additional Benefits section of this LIMITED WARRANTY

Exclusions from Coverage
There is no coverage under this LIMITED WARRANTY for any loss:
1. That resulted from theft by any person who had access to the VEHICLE keys, or any person related to YOU by blood, marriage or adoption including wards or xxxxxx children.
2. When the keys were left in or on the VEHICLE.
3. To any VEHICLE that is used for any commercial purposes or emergency services whatsoever.
4. In which YOU fail to report the theft to the POLICE within twenty-four (24) hours of discovery of the theft.
5. In which YOU, or anyone acting on YOUR behalf, commit any fraudulent act, or falsely swear with regard to any fact or circumstance of a covered loss or claim. Additionally, there is no coverage for any loss resulting directly or indirectly from any dishonest, fraudulent, illegal or criminal act by you or anyone acting on YOUR
behalf, whether acting alone or in collusion with others; or due to conversion embezzlement or secretion by any person in lawful possession of the VEHICLE.
6. That occurs outside the United States, its territories or possessions.
7. In which the VEHICLE is car jacked.
8. In which the VEHICLE is burned and not as a direct result of theft.
9. Where the owner (YOU) of the VEHICLE failed to take reasonable precautions against theft.
10. If the VEHICLE is considered a total loss and not as a direct result of theft.
11. Caused directly or indirectly by terrorism, including action in hindering or defending against an actual or expected incident of terrorism; such loss or damage is excluded regardless of any other cause or event that contributes concurrently or in any sequence to the loss.
12. Caused by incidental or consequential damages including, but not limited to, loss of use of specified VEHICLE or resulting inconvenience, loss of time, storage charges, lodging, other travel cost, income, maintenance, or from the breach of any implied warranties arising by law. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion may not apply to YOU.
Other Items of Importance
The THEFT DETERRENT SYSTEM is permanently installed on the VEHICLE; therefore, this LIMITED WARRANTY is non-cancellable and non-refundable.
Limit of Liability
The total of all BENEFITS paid or payable under this LIMITED WARRANTY shall not exceed the BENEFIT amount stated on the first page of this LIMITED WARRANTY or ACTUAL CASH VALUE of the VEHICLE and in no event will the liability of this LIMITED WARRANTY ever exceed the BENEFIT amount stated on the first page of this LIMITED WARRANTY or ACTUAL CASH VALUE of the VEHICLE.
Termination
WE may direct termination of this LIMITED WARRANTY if the operation of the VEHICLE fails to comply with the Terms and Conditions of this LIMITED WARRANTY or due to YOUR material misrepresentation or fraud at the time of purchase.
This LIMITED WARRANTY is issued exclusively to YOU with respect to the VEHICLE identified on page one of this LIMITED WARRANTY and remains in effect only for so long as YOU own the VEHICLE unless it has been properly transferred to another private individual.
IF ANY PROVISION CONTAINED IN THIS LIMITED WARRANTY IS FOR ANY REASON HELD BY A COURT OF COMPETENT JURISDICTION TO BE INVALID OR UNENFORCEABLE, SUCH INVALIDITY OR UNENFORCEABILITY WILL NOT AFFECT ANY OTHER PROVISIONS OF THIS CONTRACT.
Transfers
This LIMITED WARRANTY may be transferred upon the resale of the VEHICLE to a private individual. However, this LIMITED WARRANTY may not be assigned separately from the VEHICLE, nor can it be assigned to anyone other than an individual person that purchased the VEHICLE. Within thirty (30) days from the date of sale to a private party (not a dealer or entity in the business of selling, trading or leasing vehicles), submit the following:
1. A check for a fifty dollar ($50.00) transfer fee payable to US;
2. A copy of page one of this LIMITED WARRANTY;
3. A signed affidavit stating the date of sale and the new owner’s name, address, email address and telephone number.
