Contracting parties and duration of contract 1.1. Contracting parties The contracting parties are the Renter (hereinafter the “Renter”) and Galería 19 Mallorca Norte S.L., ▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇ ▇▇, ▇▇-▇▇▇▇▇ ▇▇▇▇▇ ▇▇ ▇▇▇▇ (hereinafter the “Lessor”). Upon receipt of a rental bike from the cycle park (hereinafter “bicycle”), a contract is formed between the Renter and the Lessor. The Lessor must for the duration of the contract provide the Renter with a bicycle in a usable and roadworthy condition. Upon formation of the contract the full rental price must be paid in advance by the Renter. The applicable prices are those valid at the time of rental (see ▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇). 1.2. Duration of contract and liability for default The rental agreement is concluded for a particular period. If the rental commences after 5 p.m., this day will not be charged. If return of the bicycle is delayed, the rental contract is not extended. If the Renter – even through no fault of his/her own – does not return the bicycle to the Lessor at the end of the agreed rental period, the Lessor is entitled for the duration of the delay to require payment by way of compensation for use of at least the amount of the previously agreed rental price. The Lessor may claim further damages if the Renter is responsible for the delay. 1.3. Early return If the Renter returns the bicycle before the contractually agreed end of the rental period, he/she has no right to reimbursement of the difference in price. This does not affect the right to extraordinary termination for good cause.
