bau GmbH and BITZER Kühlmaschinenbau Schkeuditz GmbH ("the Enterprise") with the Supplier shall be governed exclusively by the General Purchasing Terms and Conditions set forth hereafter. With the acceptance of an order by the Supplier, or with the delivery of the ordered goods at the latest, the Supplier shall acknowledge the exclusive applic- ability of these General Purchasing Terms and Conditions. These T&C shall apply also to all future deliveries, services or offers provided to the Enterprise, even if they are not agreed on separately once again. If any opposing, deviating or supplementing terms and conditions are used by the Supplier, they shall not apply to the relations with the Enter- prise even if the Enterprise does not explicitly oppose to them or the Supplier indicates that he wants to deliver only under his own terms and conditions.
