Acceleration Costs definition

Acceleration Costs means those fully documented increased costs reasonably incurred by Design-Builder (that is, costs over and above what Design-Builder would otherwise have incurred) which are directly attributable to increasing the performance level of the Work in an attempt to complete necessary Activities of the Work earlier than otherwise anticipated, such as for additional equipment, additional crews, lost productivity, overtime and shift premiums, increased supervision and any unexpected material, equipment or crew movement necessary for resequencing in connection with acceleration efforts. Profit, overhead and indirect costs in connection with acceleration efforts shall not exceed the limits set forth in Contract Section 12.
Acceleration Costs means those fully documented increased costs reasonably incurred by DB Contractor (that is, costs over and above what DB Contractor would otherwise have incurred) which are directly and solely attributable to increasing the rate at which the Work is performed in an attempt to complete necessary elements of the Work earlier than otherwise anticipated, such as for additional equipment, additional crews, lost productivity, overtime and shift premiums, increased supervision and any unexpected material, equipment or crew movement necessary for re- sequencing in connection with acceleration efforts or a Recovery Schedule.
Acceleration Costs means the reasonable direct incremental costs plus a margin of [**]% incurred by the Contractor reasonably involved in accelerating Delivery to overcome or minimise the extent and effects of some or all of a delay.

Acceleration Costs means those fully documented increased costs reasonably incurred by Contractor (that is, costs over and above what Contractor would otherwise have incurred) which are directly and solely attributable to increasing the rate at which the work is performed in an attempt to complete necessary elements of the work earlier than otherwise anticipated, such as for additional equipment, additional crews, lost productivity, overtime and shift premiums, increased supervision and any unexpected material, equipment or crew movement necessary for re-sequencing in connection with acceleration efforts and/or a Recovery Schedule. Affiliate shall mean: (1) any Person which directly or indirectly through one or more intermediaries controls, or is controlled by, or is under common control with, Contractor or any Major Participant, and (2) any Person for which 10% or more of the equity interest in such Person is held directly or indirectly, beneficially or of record by Contractor, any Major Participant or any Affiliate of Contractor under clause (1) of this definition. For purposes of this definition the term ―control‖ means the possession, directly or indirectly, of the power to cause the direction of the management of a Person, whether through voting securities, by contract, family relationship or otherwise.
