A “claim” or “dispute,” as used in this Section IV (Arbitration and Waivers), is any unresolved disagreement between you, us and/or our Service Provider, arising from or relating in any way to the Account, Card or this Agreement.
Debits include withdrawals, transfers, payments from your Account, Card transactions and fees.
In this Agreement, the words you and yours mean those who sign the application or Account Card as applicants, joint owners or any authorized users.
In this Agreement, the words “you” and “yours” mean anyone who signs an Ac- count Card or Account Change Card (Account Card).
By signing an Account Card, each of you, jointly and severally, agree to the terms and conditions in this Agree- ment and Account Card, The Funds Availability Policy Disclosure, Truth-in-Savings Rate and Fee Schedule (Rate and Fee Schedule), and any Account Receipt accompanying this Agreement, as well as the Credit Union’s Bylaws and Policies; and any amendments to these documents which collectively govern your Membership and Accounts.
Your signature on the Account Card, or authentication and approval of your account, authorizes your account access.
This Section IV (Arbitration and Waivers) shall survive termination of your Account, Card, any voluntary payment of any debt owed to us and paid in full by you, any legal proceeding by us to collect a debt owed by you, and/or any bankruptcy by you or us.
Unless otherwise stated on the Account Card or documented through the Credit Union’s online application and authentication process, a joint account includes rights of survivorship.
Your account type(s) and ownership features are designated on your Account Card.
To the extent any dispute arising under this Agreement or relating in any way to your Account, Card or your relationship with us is not arbitrated, you consent to the jurisdiction of, and agree that such dispute will be resolved by the Federal or state court located in Shelby County, Tennessee.
