Additional Plants definition

Additional Plants has the meaning set forth in Section 4.1.
Additional Plants shall have the meaning ascribed to such term in Section 5.02;
Additional Plants means any photovoltaic plants in Italy which may be acquired in the context of a Qualified Investment. Following the perfection of a Qualified Investment and the acquisition of the relevant Additional Plant, each Additional Plant is deemed a “Plants” under these Terms and Conditions and all the Additional Plants will be automatically subject to all the representations and warranties and all the covenants and obligations provided under these Terms and Conditions.

  • The Owner Participant further agrees that, on the terms and conditions set forth in the Actual Development Plan, it will direct the Owner Lessor to grant to the Additional Plants Operator, easements across the Facility Site which are reasonably required for access to the Additional Plants, fuel supply (including gas pipelines) for the Additional Plants, and electric transmission lines to and from the Additional Plants as set forth in the Actual Development Plan.

  • Recreation Facility Operator Assistants will pay union dues in accordance with the Union Constitution and bylaws based on weekly earnings, subject to any binding legal direction otherwise.

  • At such time as EME determines the specifications for the Additional Plants, Xxxxx City will prepare a written presentation, including site maps, to be made to the Owner Participant, setting forth the terms and conditions on which it plans to develop the Additional Plants and the physical specifications for operation of the Additional Plants (the "DEVELOPMENT PRESENTATION").

  • Xxxxx City may revise the Development Presentation to incorporate the Owner Participant's modifications (the "REVISED DEVELOPMENT PRESENTATION"; the Development Presentation, if not objected to by the Owner Participant and the Revised Development Presentation, if applicable, are hereinafter referred to as the "ACTUAL DEVELOPMENT PLAN") and thereafter EME may develop the Additional Plants in accordance with the Revised Development Presentation and in a manner which avoids Material Impairment.

  • The first of the Additional Plants to be located in Thailand, with a target annual capacity of 65,000 MT of BSA and 50,000 MT of BDO, or a combination thereof as the applicable parties may agree.

  • The BioAmber Parties and Mitsui shall discuss in good faith the construction and operation of the Additional Plants, according to terms and conditions between them similar to those applicable to the Initial Plant or as such parties may otherwise agree.

  • The second of the Additional Plants, with a target annual capacity of 65,000 MT of BSA and 50,000 MT of BDO, or some combination thereof as the applicable parties may agree, to be located in either: (a) [***], U.S.A., [***]; or (b) Brazil, [***].

  • As to electricity or other energy generated by all additional plants built on the leased land or, if applicable, the Adjacent Lease from geothermal resources therein, other than the Existing Plant or the New Plants (the "Additional Plants"), Lessee shall pay to Lessor during the remainder of the full term of the Lease, royalties as provided at Subparagraphs 5.2, 5.3, 5.4, 5.6 and 5.7 above.

  • Without limiting the generality of the foregoing, as between such parties, none of the BioAmber Parties nor Mitsui shall have any obligation in respect of the construction of any of the Additional Plants, which construction is subject to, among other things, satisfactory market feasibility studies, agreement on capital budgets and obtaining necessary internal approvals, all at the sole discretion of each such party.

  • Notwithstanding the preceding sentence, in the event that Mitsui shall have elected not to participate in the first Additional Plant, Mitsui shall relinquish its right to participate in the second Additional Plant and BioAmber shall thereupon be free to discuss and negotiate with any other Person and enter into such Contracts as it may choose with other Persons in respect of their participation in either or both of the Additional Plants.

Related to Additional Plants

  • Constructional Plant means all appliances or things whatever nature required in or about the execution, completion or maintenance of the works or temporary works (as hereinafter defined) but does not include materials or other things intended to form or forming part of the permanent work or temporary housing, hutting, office, stores, etc.,

  • Project site, where applicable, means the place indicated in bidding documents.

  • Expansion Project has the meaning set forth in Section IV.3.a of this Agreement.

  • Built-Up Area and/or “Covered Area” in relation to a Flat shall mean the floor area of that Flat including the area of balconies and terraces, if any attached thereto, and also the thickness of the walls (external or internal) and the columns and pillars therein Provided That if any wall, column or pillar be common between two Flats, then one-half of the area under such wall column or pillar shall be included in the built-up area of each such Flat.

  • The Project Site, where applicable, means the place or places named in the SCC.

  • Original Project means the Project described in the Original Financing Agreement.

  • Slum area means any area where dwellings predominate which, by reason of depreciation, overcrowding, faulty arrangement or design, lack of ventilation, light or sanitary facilities, or any combination of these factors, are detrimental to the public safety, health or morals.

  • Substitute Improvements means the substitute or additional improvements of the Issuer described in Article V hereof.

  • Infrastructure Improvements means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. Infrastructure improvements also include 1 or more of the following whether publicly or privately owned or operated or located on public or private property:

  • Excavation work means the making of any man-made cavity, trench, pit or depression formed by cutting, digging or scooping;
