Additional Released Claims definition
Additional Released Claims means any and all claims, liens, demands, actions, causes of action, rights, duties, obligations, damages or liabilities of any nature whatsoever, whether legal or equitable or otherwise, known or unknown, that actually were, or could have been, asserted in the Actions or the Consolidated Action, whether based upon any violation of any state or federal statute or common law or regulation or otherwise, or arise directly or indirectly out of, or in any way relate to, allegations (a) that Plaintiffs and/or Proposed Intervenors have had in the past or now have against Released Defendants, whether or not related to the Released Claims, on the one hand, and (b) that Released Defendants could have alleged against Plaintiffs and/or Proposed Intervenors in relation to the Actions or the Consolidated Action, on the other hand.
Examples of Additional Released Claims in a sentence
In addition to the releases granted by Releasing Plaintiffs in the prior section, upon the Effective Date, Releasing Plaintiffs, on the one hand, and Released Defendants, on the other hand, shall have unconditionally, completely, and irrevocably released and forever discharged each other from and shall be forever barred from instituting, maintaining, or prosecuting any and all Additional Released Claims as defined in Section 2.3.
However, for purposes of clarity, the Agreement is a complete defense to any attempt to assert any Released Claims or Additional Released Claims.
A new Appendix 1A (Additional Released Claims) is added to the Agreement as set forth in Attachment #1 hereto.
