These Agreement Conditions together with the IPA constitutes the entire agreement and contains the entire understanding of the parties with respect to its subject matter and supersedes and extinguishes all prior oral and written communications between the parties about its subject matter.
Nevertheless, according to the Grant Agreement (Conditions, Articles 5.5 and 39), modifications of the budget between work packages/activities are subject of an official amendment and will have to be necessarily reported to the Coordinator and be approved by him/her.
Every Partner also may be requested to provide additional supporting documents or evidence that are typically required for another type of check, as specified in Article 25 of the Grant Agreement (Conditions).
If necessary, the Coordinator will clear such changes with the NA (Reference Grant Agreement, Conditions, Article 5.5: “Amendments for transfers between work packages are moreover possible only if: the work packages concerned are not already completed (and declared in a financial statement) and the transfers are justified by the technical implementation of the action.”).
This period is longer if a longer duration is required by national law, or if there are ongoing audits, appeals, litigation or pursuit of claims concerning the grant, including in the cases referred to in Articles 20.1 and 25 of the Grant Agreement (Conditions) and Xxxxx XX, Article 8.
