Annual Technical Support Fee means the annual fee for technical support payable to BCIL under the Technical Support Agreement;

If Customer reports a Deficiency within the Warranty Period and Tjene fails to repair or provide a workaround for such Deficiency within ninety (90) days after receipt of such notice, Customer may terminate its license to use the relevant Tjene Software on written notice to Tjene, in which event Tjene shall promptly refund to Customer the License Fee and a pro rata refund of the Annual Technical Support Fee paid hereunder.
