Apex Note Claims definition
Apex Note Claims means the Claims against Curative arising under the Amended and Restated Promissory Note, dated May 30, 2002, issued by Curative pursuant to the Apex Stock Purchase Agreement.

Related to Apex Note Claims
Subordinated Claims shall have the meaning set forth in Section 3.6(c)(i) hereof.
Secured Claims means Claims held by “secured creditors” as defined in the CCAA, including Construction Lien Claims, to the extent of the Allocated Value of the Property securing such Claim, with the balance of the Claim being a Deficiency Claim, and amounts subject to section 6(6) of the CCAA;
Subordinated Note Documents means the indenture under which the Subordinated Notes were issued and all other instruments, agreements and other documents evidencing or governing the Subordinated Notes or providing for any Guarantee or other right in respect thereof.
Subordinated Note Amount has the meaning set forth in the Recitals.
Intercompany Claims means, collectively, any Claim held by a Debtor against another Debtor.
