Applicable Software definition

Applicable Software is defined in paragraph 8. 6(e). -------------------
Applicable Software is the following: (i) the Licensed Software (including all versions then being distributed by Compaq under this Agreement); and (ii) either (a) if the Licensed Software contains Excluded Source Code, then the latest version of the Licensed Software that does not include Excluded Source Code, or (b) if none of the versions of the Licensed Software is free of Excluded Source Code, then version 5.1 of Altiris eXpress (whether or not version 5.1 of Altiris eXpress includes Excluded Source Code). Compaq will obtain its own licenses for Excluded Source Code, including payment of any applicable royalties or other fees.
Applicable Software means Software in respect of which this Agreement has been terminated under this paragraph, which were ordered by Digital under this Agreement before the date of termination, and for which payment has not at that date become due from Digital.

  • Digital's total liability under sub-paragraph (a) above shall not in any circumstances exceed the price that would have been payable by Digital for Applicable Software if this Agreement had not been terminated.

  • The former Authorized User's right to use the Applicable Software shall immediately terminate when the reassignment is effective and Company shall promptly terminate the former Authorized User's use of the Hosted Services and ensure that the Nuance Software is uninstalled from the former Authorized User's devices.

  • The "Retail Expert" software, the Genesis financial software and the Peoplesoft Improvements are referred to herein collectively as the "Applicable Software." The right, title and interest referred to in the first sentence of this Section 14.3.2 is only in respect of the Applicable Software as developed through the Closing.

  • None of the Seller or its Subsidiaries shall have any right to any improvements made to the Applicable Software following the Closing by Buyer or its Subsidiaries and none of Buyer or its Subsidiaries shall have any right to any improvements made to the Applicable Software following the Closing by Seller or its Subsidiaries.

  • Digital shall not be liable to pay for any Applicable Software that, at the date of termination, Digital is entitled to reject (including any Software for which Digital may have issued a Certificate of Commercial Service) or has already rejected.

  • Applicable Software Terms are incorporated herein by thisreference.

  • Any such modification or customization of the Applicable Software, as well as any modification or customization of the SDK in furtherance of the foregoing, is limited to use in support of Customer’s internal business operations.

  • Distribution of the Applicable Software is intended to be subject to the same terms as set forth in Section 3.1 and this Agreement, including the provisions regarding ownership, all of the restrictions set forth in this Agreement, and payment of royalties under Section 7.


More Definitions of Applicable Software

Applicable Software means the Dragon Medical 360 | Network Edition (DMNE) Software specified in an Order as being licensed pursuant to the “Physician Client License” or the “Non-Physician Client License” License Model; and which Software requires Company to have a valid licensed copy of NMS Software (licensed separately).
Applicable Software means the Company’s Quality Programme, which includes the software “Colour Lab”
Applicable Software means the Nuance Management Server for Dragon Medical 360 | Network Edition Software specified in an Order, which Software consists of the Nuance Management Server (NMS) Software and the Dragon Medical 360 | Network Edition (DMNE) Software.

Related to Applicable Software

  • Service Software means any and all software applications and any third-party or other software, and all new versions, updates, revisions, improvements and modifications of the foregoing, that Contractor provides remote access to and use of as part of the Services.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Oracle Software means any software agent, application or tool that Oracle makes available to You for download specifically for purposes of facilitating Your access to, operation of, and/or use with, the Services.

  • Third Party Software means software which is proprietary to any third party (other than an Affiliate of the Contractor) which is or will be used by the Contractor for the purposes of providing the Services.

  • Public Software means any Software that contains, or is derived in any manner (in whole or in part) from, any software that is distributed as free software, open source software (e.g., Linux) or similar licensing or distribution models, including, without limitation, software licensed or distributed under any of the following licenses or distribution models, or licenses or distribution models similar to any of the following: (A) GNU’s General Public License (GPL) or Lesser/Library GPL (LGPL), (B) the Artistic License (e.g., PERL), (C) the Mozilla Public License, (D) the Netscape Public License, (E) the Sun Community Source License (SCSL), (F) the Sun Industry Standards License (SISL), (G) the BSD License, and (H) the Apache License.
