ASBESTOS LITIGATION definition

ASBESTOS LITIGATION means any litigation, suit, action, arbitration or proceeding instituted or made against the Revolving Borrower or any of its Subsidiaries, or between the Revolving Borrower or any of its Subsidiaries and any insurer, or including the Revolving Borrower or any of its Subsidiaries and involving any insurance policy of the Revolving Borrower or any of its Subsidiaries, in each case, arising from or related to any liability, claim, judgment, order or decree related to asbestos, including, without limitation, any Personal Injury Asbestos Claim and any Asbestos Building Material Claim.
ASBESTOS LITIGATION means the complaint filed on January 2, 2003 against Penhall, among others, in the Superior Court of California, County of Orange under the caption ▇▇▇▇▇▇▇▇▇ v. Amcord Inc. for personal injuries related to the inhalation of asbestos fibers released by the handling of asbestos containing products during the course of plaintiffs' employment over a period of years on various construction sites.

  • Threatened litigation as used herein shall include governmental investigations and civil investigative demands. “Litigation” as used herein shall include administrative enforcement actions brought by governmental agencies.
