The determination of the Actual Assessable Space (square feet) in each instance shall be based on completed building permit applications or issued building permits for the DU to be constructed on the Property.
If the Developer obtains Certificates of Compliance (defined in Section 2) from the District as development of the Property progresses, rather than prepaying for all SFDU to be constructed, the District shall determine the total Actual Assessable Space upon request by Developer for issuance of the last of the Certificates of Compliance for DU to be constructed on the Property.
In the event the District is to reimburse the Developer pursuant to Subsection (b) of this Section, because the Actual Assessable Space averages less than 3,250 square feet per SFDU, then the per-square-foot amount adjusted pursuant to this Subsection shall be applied to the total shortfall in square feet on a proportionate basis.
Notwithstanding the foregoing, if the Actual Assessable Space is less than 3,250 square feet multiplied by the number of such SFDU, the District shall reimburse the to the Developer an amount equal to $5.87 multiplied by the total shortfall in square feet.
As an illustration of the foregoing, if the Actual Assessable Space totals 300,000 square feet, and 150,000 square feet are constructed in each year over a two-year period commencing the first year this Agreement is in effect, then $5.87 would be multiplied by one-half of the shortfall, and the $5.87 amount as adjusted in accordance with the Index would be multiplied by one-half of the shortfall, in order to calculate the reimbursement amount.
If the Developer obtains Certificates of Compliance from the District by prepaying for all SFDU to be constructed, the District shall determine the total Actual Assessable Space after issuance to Developer of the last of the building permits for DU to be constructed on the Property.
