Assignable Charter definition

Assignable Charter means, in relation to the Ship, any time charterparty, consecutive voyage charter or contract of affreightment in respect of the Ship having a duration (or capable of exceeding a duration) of 12 months or more and any guarantee of the obligations of the charterer under such charter or any bareboat charter in respect of the Ship and any guarantee of the obligations of the charterer under such bareboat charter, entered or to be entered into by the Borrower and a charterer or, as the context may require, bareboat charterer and, in the plural, means all of them;
Assignable Charter means, in relation to a Ship, any time charterparty, consecutive voyage charter or contract of affreightment in respect of such Ship having a duration (or capable of exceeding a duration) of 18 months or more and any guarantee of the obligations of the charterer under such charter or any bareboat charter in respect of that Ship (irrespective of its duration) and any guarantee of the obligations of the charterer under such bareboat charter, entered or to be entered into by the Owner which is the owner of that Ship and a charterer or, as the context may require, bareboat charterer and, in the plural, means all of them;
Assignable Charter means any Charter in respect of the Ship which has, or is capable of having, a duration equal to or exceeding 36 months (excluding any extension options).

Examples of Assignable Charter in a sentence

  • If a Ship is subject to an Assignable Charter, such Assignable Charter and any related Charter Document for the relevant Ship duly executed.

  • The relevant Owner shall perform its obligations under the relevant Charter Documents in respect of the relevant Assignable Charter for the Ship and use its reasonable endeavours to ensure that each other party to them performs their obligations under the relevant Charter Documents.

  • Except with approval, the relevant Owner shall not terminate or rescind any relevant Charter Document in respect of the relevant Assignable Charter or withdraw the relevant Ship from service under the relevant Assignable Charter or take any similar action.

  • All Earnings which the relevant Owner is entitled to receive under the relevant Charter Documents in respect of the relevant Assignable Charter for the Ship shall be paid into the Earnings Account or, following an Event of Default, in the manner required by the Finance Documents.

  • Each Obligor who is a Party undertakes that this clause 27 will be complied with in relation to each Mortgaged Ship which is subject to an Assignable Charter and its Charter Documents, in respect of the same and throughout the relevant Mortgaged Ship's Mortgage Period.


More Definitions of Assignable Charter

Assignable Charter means a Charter with an initial term or duration in excess of (or capable of exceeding, by virtue of any optional extension) 12 months;

Assignable Charter means, in relation to a Ship, any time charterparty, consecutive voyage charter or contract of affreightment in relation to that Ship of a remaining duration (or capable of having or exceeding a duration) of 13 months or more or any bareboat charter in respect of that Ship entered into in accordance with Clauses 26.16 (Restrictions on chartering, appointment of managers etc.) and Clause 26.19 (Charter Assignment), including, for the avoidance of doubt, each Approved Charter in respect of that Ship.
