Operator is hereby granted an exclusive right to operate ATM Equipment at the Location during the term of this Agreement.
Tenant shall pay all real or personal property taxes assessed or imposed on the ATM or ATM Equipment.
Tenant shall cause the insurance policies maintained by Tenant pursuant to Section 9 to cover the ATM and the ATM Equipment and any claims and liabilities arising in connection with the use thereof and to the extent any additional insurance is required by Landlord as a result of the ATM or ATM Equipment, Tenant shall be responsible for all costs relating to such additional insurance.
Tenant shall pay all real, personal property, or other taxes or fees assessed or imposed on the ATM Equipment.
Tenant shall pay Landlord to compensate Landlord for the costs of all utilities dedicated to Tenant’s operation of the ATM and ATM Equipment (the “ATM Utility Charge”).
Further, subject to Landlord’s prior approval (which approval shall not be unreasonably withheld), Tenant shall be permitted, at Tenant’s sole cost and expense, to change the existing signage and any other advertising material or displays at the ATM Equipment (“ATM Signage”), which ATM Signage shall identify Tenant and/or any automated teller network operated by Tenant and/or any shared automatic teller networks with which the ATM Equipment is affiliated.
Tenant shall obtain all necessary permits and approvals and pay all costs of installing and maintaining the ATM and ATM Equipment.
Tenant may install Tenant’s HVAC Units, Tenant’s Back-Up Equipment, the Satellite System and the ATM and ATM Equipment and all other non-Leasehold Improvement items during the same time period as the construction of the Leasehold Improvements and by complying with the same process as provided in connection with the construction of the Leasehold Improvements, including, without limitation, any approval process for plans and specifications relating to such items.
If applicable, Fidelity will monitor all data communications circuits between the ATM Equipment and the Fidelity EFT System for continuous operation.
Tenant shall provide all security measures that are necessary or appropriate for the ATM Equipment (as reasonably determined by Landlord), including, without limitation, mirrors, surveillance cameras, door locks, adequate lighting, exterior visibility, card entry systems, and warning signage.
