Further, this Agreement shall not be deemed to require Sensormatic to continue, or to continue unmodified, any benefit plan or policy, whether or not referred to in Section 3 hereof, provided that no Change in Control shall have occurred and no Attempted Change in Control shall have occurred and then be pending.
In the event that any Attempted Change in Control is not followed by a Change in Control and is no longer pending, Sensormatic shall again be entitled to terminate this Agreement as provided in the first sentence of this Section 1(b).
