If there is Unacceptable Waste on the tipping floor that was not identified in a timely manner and returned to the Authorized Hauler that delivered such Unacceptable Waste, despite the Company’s diligence, the Company shall move the Unacceptable Waste to a specified area at the Transfer Station and notify the County and all other appropriate Governmental Bodies as required by Applicable Law.
The Company shall receive and process at the Transfer Station and Drop-Box Sites all Solid Waste delivered to the Transfer Station or Drop-Box Sites by or on behalf of the County in each Reporting Year; provided, however, that the Company may refuse delivery of (1) any waste which is not delivered by an Authorized Hauler, (2) any waste delivered at hours outside the Receiving Time, and (3) Unacceptable Waste, including as provided in subsection (F) of this Section (collectively, the “Rejection Rights”).

Authorized Hauler - Person registered and authorized by Hatboro Borough to collect, remove, transport, and dispose of municipal waste, recyclable materials, and/or leaf waste for owners or occupants of single-family residential establishments, multi-family residential establishments, commercial establishments, institutional establishments, and municipal establishments in Hatboro Borough.
If the Municipality or an Authorized Hauler on the Municipality’s behalf delivers Non-Processible Waste or Hazardous Materials to the Delivery Point, MRR will promptly notify the Municipality of such delivery by telephone (telephone number: 860-638-4850) or electronic mail (email: william.russo@middletownct.com) and may reject such material and require the Person who delivered such material to reload and dispose of such material at the sole cost and expense of such Person.
MRR should not accept Acceptable Solid Waste from any Authorized Hauler without notification and confirmation from the Municipality regarding the date of the delivery.
Prior to the designation or use of any new Authorized Hauler and prior to the termination of an existing Authorized Hauler or the extension of an agreement with an existing Authorized Hauler, the Municipality will deliver written notice to MRR of the name, address, other relevant information regarding such Authorized Hauler, as well as the dates that said Authorized Hauler may deliver Acceptable Solid Waste to the Delivery Point.
The Authorized Hauler will provide MRR with a certificate of insurance issued by the insurance carrier or its agent evidencing that all insurance coverage, including the “tail” insurance required by this Subsection (d), is in effect.
Prior to entering into an agreement with an Authorized Hauler to collectAcceptable Solid Waste, the Municipality may request that MRR approve the insurance coverage requirements set forth in said agreement, which approval will not be unreasonably withheld, conditioned, or delayed.
Each Authorized Hauler will maintain insurance of the types and with the limits specified in the Hauler’s Rules and Regulations or as may otherwise be acceptable to MRR.
