Available Goods and Services means the goods and services described in Framework Schedule 1 (Available Goods and Services) which the Supplier shall make available to Contracting Bodies;

Examples of Available Goods and Services in a sentence

  • Nothing in this Framework Agreement shall oblige any Contracting Body to place any Order for the Available Goods and Services.

  • Without prejudice to the Authority's rights to terminate this Framework Agreement as set out in Clause 27 (Termination), if a right to terminate this Framework Agreement arises in accordance with Clause 27 (Termination), or if the Authority reasonably believes that a Consistent Failure has occurred, the Authority may suspend the Supplier’s appointment to provide Available Goods and Services to Contracting Bodies under this Framework Agreement by giving notice in writing to the Supplier.

  • The Supplier acknowledges that in entering into this Framework Agreement no form of exclusivity or volume guarantee has been granted by the Authority and Other Contracting Bodies for the purchase of Available Goods and Services from the Supplier and that the Authority and Other Contracting Bodies are at all times entitled to enter into other contracts and arrangements with other providers for the provision of any or all services or goods which are the same as or similar to the Available Goods and Services.

  • The Authority appoints the Supplier as a potential provider of the Available Goods and Services and the Supplier shall be eligible to be considered for the award of Call Off Agreements for such Available Goods and Services by the Authority and Other Contracting Bodies during the Term.

  • Contracting Bodies may, at their absolute discretion and from time to time during the Term, order Available Goods and Services from the Supplier in accordance with the Ordering Procedures.

  • This Framework Schedule 10 describes the activities that the Supplier will carry out as part of its ongoing commitment to the marketing of the Available Goods and Services to Contracting Bodies.

  • The related specifications will be inserted into Framework Schedule 1 (Available Goods and Services).

  • Nothing in this Framework Agreement shall oblige any Contracting Body to enter into a Call-Off Agreement for the Available Goods and Services.

  • If the Authority or any Other Contracting Body decides to source the Available Goods and Services through the Framework then it will award its Goods and Services Requirements in accordance with the procedure in paragraph 7 (and schedule 3 - Ordering Form) and the requirements of the Regulations and the Guidance.

  • The Authority may require the Supplier to terminate a Sub-Contract where it considers that: the Sub-Contractor may prejudice the provision of the Available Goods and Services or may be acting contrary to the interests of the Authority; the Sub-Contractor is considered to be unreliable and/or has not provided reasonable goods and/or services to its other customers; and/or the Sub-Contractor employs unfit persons; provided that such right shall not be exercised unreasonably, frivolously or vexatiously.

  • Goods and Services or "goods or services" means any work, labor, commodities, equipment, materials, or supplies of any tangible or intangible nature, except real property or any interest therein, provided or performed through a contract awarded by a purchasing agent, including goods and property subject to N.J.S.A. 12A:2-101 et seq.

  • Integrated Goods and Services Tax Act means the Integrated Goods and Services Tax Act, 2017;

  • Products and Services means the products and/or services to be sold by Vendor hereunder as identified and described on Attachment A hereto and incorporated herein, as may be updated from time to time by Vendor to reflect products and/or services offered by Vendor generally to its customers.

  • Goods and Services Tax (GST) shall mean any tax payable on the supply of goods, services or other things in accordance with the provisions of GST Law.

  • Cannabis wholesaler means any licensed person or entity that purchases or otherwise obtains, stores, sells or otherwise transfers, and may transport, cannabis items for the purpose of resale or other transfer to either another cannabis wholesaler or to a cannabis retailer, but not to consumers.

  • Supplementary aids and services means aids, services and other supports that are provided in regular education classes or other education-related settings and in extracurricular and nonacademic settings to enable children with disabilities to be educated with children without disabilities to the maximum extent appropriate.

  • Tobacco products means cigars, cigarettes, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco, snuff, snuff flour, moist snuff, cavendish, ping and twist tobacco, fine-cut and other chewing tobaccos, shorts, refuse scraps, clippings, cuttings and sweepings of tobacco, and other kinds and forms of tobacco, prepared in such manner as to be suitable for chewing or smoking in a pipe or otherwise, or both for chewing and smoking.

  • the Products means all products and associated documentation to be supplied under this Contract;

  • Harmonized System or “HS” means the Harmonized Commodity Description and Coding System set out in the Annex to the International Convention on the Harmonized Commodity Description and Coding System, and adopted and implemented by the Parties in their respective laws;

  • Consumption Data means customer specific electric usage data, or weather adjusted data, including but not limited to kW, kWh, voltage, var, power factor, and other information that is recorded by the electric meter for the Company and stored in its systems. Consumption Data also includes payment and service history, account number, and amount billed.

  • Centralized Message Distribution System (CMDS) means the industry-wide data collection system, which handles the daily exchange of message details between CMDS participating telephone companies (also known as CMDS Direct Participants). AT&T-21STATE is a CMDS Direct Participant.

  • Red Hat Products means Software, Services, Subscriptions and other Red Hat branded offerings made available by Red Hat.

  • Freight forwarding services means the activity consisting of organising and monitoring shipment operations on behalf of shippers, through the acquisition of transport and related services, preparation of documentation and provision of business information.

  • End Users means a Third Party residence or business that subscribes to Telecommunications Services provided by any of the Parties at retail. As used herein, the term “End User(s)” does not include any of the Parties to this Agreement with respect to any item or service obtained under this Agreement.

  • Refined Products means gasoline, diesel fuel, jet fuel, asphalt and asphalt products, and other refined products of crude oil.

  • Ultra Low Sulfur Diesel Fuel means diesel fuel that has a sulfur content of no more than fifteen parts per million.

  • wholesale customer means a natural or legal person purchasing electricity for the purpose of resale inside or outside the system where he is established;

  • Software Products means any and all Software that is or has been distributed by the Division or Division Subsidiaries and their predecessors, and any similar products developed or under development by Seller relating to the Business as of the date of the Agreement, and all documentation, packaging materials, promotional materials, and training materials relating to any of the foregoing.

  • Licensed Services means all functions performed by the Licensed System.

  • Broadband Services means Verizon's Fios or DSL-based Internet services (whichever applies). Verizon's DSL-based Internet service is also known as "High Speed Internet" ("HSI").
