Believes on reasonable grounds means the CEO must have a basis for the belief. It is the responsibility of the enforcement body to be able to justify the reasonable grounds for this belief, and the decision should be documented. ‘Reasonable belief’ is discussed further in Chapter B of the OAIC’s APP Guidelines.26
