Benchmark Process definition

Benchmark Process has the meaning given in the BENCHMARKING SCHEDULE. Confidential Glossary to Systems Services Agreement Cause means termination of this Agreement by Company pursuant to Section 12.3 of this Agreement.

Examples of Benchmark Process in a sentence

  • Company and Provider shall engage in the Benchmark Process provided for in the BENCHMARKING SCHEDULE.

  • Any disputes between the Parties concerning the selection of the Benchmarker, the Benchmark Process, the Benchmark Results, or any other aspects of benchmarking may be escalated to the Executive Steering Committee for final and binding resolution.

  • BENCHMARK RESULTS shall mean the results of the Benchmarking Process delivered by the Benchmarker in a written report to Company and Provider, including any supporting documentation requested by Company or Provider to analyze the results of the Benchmark Process.

  • EMW, IBM and the Benchmarker shall conduct the Benchmark Process according to the following methodology.

  • Customer represents that each Benchmarker is qualified to perform the Benchmark Process based on their demonstrated skills, experience, responsiveness, objectivity and fees.

  • The Benchmark Process may be initiated upon EMW's request received by IBM upon at least 30 days prior notice and no earlier than the second anniversary following the Effective Date and thereafter not more often than once every two Contract Years.

  • Upon completion of the Benchmark Process, Customer and Administrator shall review the Benchmark Results during the thirty (30) day period following delivery to Customer and Administrator of the Benchmark Results, and shall in good faith discuss any appropriate adjustments to the Service Levels or Charges under this Agreement, and identify and resolve any disagreements or variances from the Benchmark Results.

  • If EMW plans to review fewer than all of the Service Categories, IBM may require that all Service Categories be included in the Benchmark Process, by giving notice to EMW within 15 days after the date of EMW's notice of EMW's intent to commence the Benchmark Process.

  • The Benchmark Process may be initiated by Customer by giving at least ninety (90) days prior notice to Administrator.

  • Any adjustments shall be made on a prospective basis only, beginning thirty (30) days after the Benchmark Process is completed.
