Business Partner Software means the third party Software listed in Paragraph 3.1 of Section II delivered by HBOC to Customer as part of the Software, and is governed by the terms and conditions set forth in this Agreement and, if applicable, any additional terms set forth in Section III of this Agreement and any Exhibits thereto.

Business Partner Software means a Business Partner Product that is a software product. Unless otherwise expressly specified in this Agreement or on a Product Schedule, Business Partner Software will be provided only in object code form. ​

Examples of Business Partner Software in a sentence

  • In addition to the above, the following services and Software improvements shall be provided as part of Software Maintenance for the Software specified below: - STAR, Pathways, and related Business Partner Software Maintenance shall include federal and state mandated changes for acute care hospitals in the areas of patient accounting, payroll and medical records, made by HBOC to the Software after the Software delivery date but not separately priced or marketed by HBOC.

  • Any additional terms and conditions required for non-HBOC-owned software, including Business Partner Software, will be attached to the Contract Supplement as additional Exhibit(s).

  • During the term of this Agreement, Business Partner will not market the Business Partner Software to the companies listed in Exhibit D.

  • Notwithstanding anything to the contrary in this Agreement, HBOC shall have the right , with mutual agreement with HBOC's Customers, to incorporate HBOC's logo and other information in the Business Partner Software and sublicenses to HBOC Customers.

  • Business Partner shall be responsible for installation and implementation of the Business Partner Software for HBOC Customers.

  • In addition to any other remedy available at law or in equity to COMPANY in the event of breach of warranty, if the Business Partner Software fails to conform to the warranties set forth in Sections 6.1.1, 6.1.2 and 6.1.4 above, then Business Partner will promptly and continuously provide software support in accordance with the terms of the Agreement to cause the Business Partner Software to perform as warranted.

  • In the event that HBOC can reasonably demonstrate the need to replace or substitute any Business Partner Software, the parties agree to negotiate in good faith as to the terms and conditions for Customer to obtain reasonably comparable software or to retain the Business Partner Software initially licensed.

  • Business Partner makes no warranties of medical information or representations, not withstanding section 11.1.2, except as set forth in Business Partner's limited warranty which is included with the Business Partner Software and related End-User documentation in Exhibit K.

  • HBOC and Business Partner will mutually agree upon terms and conditions under which advertisements can be sold by Business Partner, HBOC and HBOC's Customers for display within the Business Partner Software sublicensed to HBOC Customers.
