In the event of non-consensus between Lead Plaintiff and the Canadian Representative Plaintiffs, each shall apply forthwith to their respective courts, on notice to one another, for an order either terminating this Settlement as it applies to their class, directing specific performance of Nortel’s obligation to issue and/or deliver such shares, or obtain such other available relief.
