Capital Repairs means (i) any maintenance, repairs or replacements to the roof, foundation and structural elements of the Premises, (ii) any maintenance, repairs or replacements to the Premises’ systems (which shall include the heating, ventilating, air-conditioning, plumbing, electrical, mechanical and other systems and equipment serving the Premises generally), the common areas or the exterior of the Premises and (iii) maintenance, repairs or replacements to the Premises required to comply with any laws applicable to the Premises (to the extent not relating to LESSEE’s use or occupancy of the Premises) enacted or promulgated after the date of this Lease, in each case, the cost of which is properly characterized as property, plant and equipment according to generally accepted accounting practices. LESSOR, at its expense (subject to reimbursement by LESSEE to the extent provided in Section 6.1 (b)), shall be responsible for all Capital Repairs necessary to keep the Premises in as good condition as exists as of the Effective Date or to comply with any laws applicable to the Premises (to the extent not relating to LESSEE’s use or occupancy of the Premises) enacted or promulgated after the Effective Date. LESSOR shall complete such repairs in a good and workmanlike manner consistent with normal and customary industry standards for buildings similar to the Premises and in compliance with all applicable laws.

Capital Repairs means capital repairs, replacements, and improvements of any kind or nature to any item, feature, component or other element of the Premises included in the construction of the Premises, including all such items, features, components, and other elements required by the Development Agreement and existing as of the date of Substantial Completion and any item, feature, component or other element that will be completed after the date of Substantial Completion in order that the terms and conditions of the Development Agreement are satisfied.

• Although every care will be taken during the delivery of the appliance(s), neither the delivery drivers nor Capital Repairs Ltd can take responsibility for damage to persons, property or the appliance(s) during the delivery, once a disclaimer form has been signed.

• We only fit parts supplied by Capital Repairs Ltd to ensure quality of repair, safety and guarantee, if on occasion we agree to fit customer supplied parts due to our call / labour charges being kept at a very low level there may be an additional charge to fit customer supplied parts and additionally the guarantee on the repair will not be applicable.

More Definitions of Capital Repairs

Capital Repairs means all work (including labor, materials and supplies) determined by Tenant to be necessary or advisable, in accordance with Section 12 hereof, for the maintenance (preventive and otherwise) or repair of the Facility Premises and the structures, surfaces, fixtures, equipment and other components thereof, to keep the Facility Premises in normal operating condition in accordance with the Facility Standard of Care.

Capital Repairs means, collectively, any capital improvements, repairs, replacements, or restoration (but expressly excluding any capital upgrades to the extent provided in Section 7 hereof) with respect to the Improvements, including the furniture, fixtures, machinery and equipment thereon, the depreciable life of which, according to GAAP, is in excess of one year.

Capital Repairs means any renovation, replacement, repair or improvement to the Asset or Property, the cost of which constitutes a Capital Expenditure and any renovation, replacement, repair or improvement set forth and approved in the GVHA Capital Budget.

Capital Repairs means: (i) all maintenance, repair, and replacement of all or any portion of the Structural Elements and (ii) all repair and replacements to any portion of the Premises, to the extent the same may be capitalized in accordance with generally accepted accounting principles, including, but not limited to, replacements to the Building Systems and/or the repaving and/or replacement of the parking areas.

Capital Repairs shall also include, but shall not be limited to, the following:

Capital Repairs means (a) any and all work necessary, desirable or appropriate to repair, restore, refurbish or replace any equipment, structure or any other component of the Project Facilities (or any portion thereof) after Project Completion, including any such work necessitated by (i) any defect or deficiency, (ii) physical or functional obsolescence of the Project Facilities, as adjudged by Prudent Utility Practices, or (iii) modifications required by any Applicable Law or dictated by the observance of Prudent Utility Practices or (b) the substitution, replacement, enlargement or improvement of any structure, facility, equipment, Property, land or land rights constituting part of the Project Facilities.
