Capital Repairs definition

Capital Repairs means (i) any maintenance, repairs or replacements to the roof, foundation and structural elements of the Premises, (ii) any maintenance, repairs or replacements to the Premises’ systems (which shall include the heating, ventilating, air-conditioning, plumbing, electrical, mechanical and other systems and equipment serving the Premises generally), the common areas or the exterior of the Premises and (iii) maintenance, repairs or replacements to the Premises required to comply with any laws applicable to the Premises (to the extent not relating to LESSEE’s use or occupancy of the Premises) enacted or promulgated after the date of this Lease, in each case, the cost of which is properly characterized as property, plant and equipment according to generally accepted accounting practices. LESSOR, at its expense (subject to reimbursement by LESSEE to the extent provided in Section 6.1 (b)), shall be responsible for all Capital Repairs necessary to keep the Premises in as good condition as exists as of the Effective Date or to comply with any laws applicable to the Premises (to the extent not relating to LESSEE’s use or occupancy of the Premises) enacted or promulgated after the Effective Date. LESSOR shall complete such repairs in a good and workmanlike manner consistent with normal and customary industry standards for buildings similar to the Premises and in compliance with all applicable laws.
Capital Repairs means capital repairs, replacements, and improvements of any kind or nature to any item, feature, component or other element of the Premises included in the construction of the Premises, including all such items, features, components, and other elements required by the Development Agreement and existing as of the date of Substantial Completion and any item, feature, component or other element that will be completed after the date of Substantial Completion in order that the terms and conditions of the Development Agreement are satisfied.
Capital Repairs means any work (including all labor, supplies, materials, equipment and costs of permits and approvals of Governmental Authorities) reasonably necessary to repair, restore, refurbish or replace (in each case, in a manner that extends the useful life thereof) any equipment, facility, structure or other Component, if such work is necessitated by:

Examples of Capital Repairs in a sentence

  • The Tenant shall have the right to request additions to, or modifications of, the R/R Project Schedule by submitting an Updated R/R Project Schedule (incorporating such proposed modifications, including any and all modifications made necessary due to Emergency Capital Repairs) to the City on or before July 1st of any year during the Term of this Agreement.

  • For each year beginning July I, 2025, and each year thereafter during the Term hereof, the Tenant shall be responsible for one hundred percent (100%) of the costs of completing all R/R Projects on the Approved R/R Project Schedule, including Emergency Capital Repairs.

  • If, at any time during the Term, the Tenant reasonably believes that Emergency Capital Repairs need to be made to the Premises, the Tenant shall immediately take corrective and preventative operational, security and safety precautions to protect all users, invitees and guests and to prevent further damage or deterioration to the Premises, which by way of illustration only, may include stopping program operations or removing one or more areas of the Premises from access and use.

  • Tenant has the obligation to implement reasonable operating accommodations to achieve ADA compliance, but to the extent that modifications to the Premises are required, they will be considered Capital Repairs pursuant to Article VIII of this Lease.

  • City may, at its cost and expense, annually review and assess Owner’s compliance with the Operating Standard, including, without limitation, Capital Repairs.


More Definitions of Capital Repairs

Capital Repairs means all work (including labor, materials and supplies) determined by Tenant to be necessary or advisable, in accordance with Section 12 hereof, for the maintenance (preventive and otherwise) or repair of the Facility Premises and the structures, surfaces, fixtures, equipment and other components thereof, to keep the Facility Premises in normal operating condition in accordance with the Facility Standard of Care.
Capital Repairs means, collectively, any capital improvements, repairs, replacements, or restoration (but expressly excluding any capital upgrades to the extent provided in Section 7 hereof) with respect to the Improvements, including the furniture, fixtures, machinery and equipment thereon, the depreciable life of which, according to GAAP, is in excess of one year.
