Cart Path Easement Areas definition

Cart Path Easement Areas shall consist of the areas identified on Exhibit C attached hereto and hereby made a part hereof. Grantor and Grantee acknowledge and agree that Grantor may, upon not less than thirty (30) days prior written notice to Grantee and with reasonable cooperation with Grantee, move the location of the Easement Areas as Grantor may deem necessary or desirable in accordance with Grantor’s plans for the development and sale of Grantor’s Property by relocating the golf cart paths and the Cart Path Facilities then situated within the Cart Path Easement Areas to new area(s) mutually agreed to by Grantor and Grantee as depicted on Exhibit C (such area(s), the “New Cart Path Easement Areas”). The area in which the New Cart Path Easement Areas may be located (but in no other areas) are shown, for location purposes, on Exhibit C. The golf cart paths and Cart Path Facilities may be relocated by Grantor anywhere within the boundaries of the areas shown on Exhibit C. Any relocation of golf cart paths and Cart Path Facilities (and the associated relocation of Cart Path Easement Areas) at the election of Grantor in accordance with this Section 3 shall: (i) be performed by Grantor in a good and workmanlike manner, pursuant to the requirements of all applicable licenses, permits, laws, approvals, rules, codes and regulations of ▇▇▇▇▇▇▇ County and or any other controlling governmental or quasi-governmental agency or entity, and diligently pursued to completion; (ii) be substantially of the same quality as the golf cart paths and Cart Path Facilities immediately before the relocation of same; and (iii) shall be performed at Grantor’s sole cost. If Grantor desires to relocate the Cart Path Easement Areas in accordance with the provisions of this Section 3, Grantee shall, within ten (10) days following a request from Grantor after substantial completion of the relocation, (a) execute and deliver to Grantor, for recording, an amendment to this Agreement showing the golf cart paths and Cart Path Facilities which have been relocated to New Cart Path Easement Areas in lieu of the prior Cart Path Easement Areas, or a new easement agreement (and, if a new easement agreement, substantially in the form of this Agreement but providing that the “Cart Path Easement Areas” are the New Cart Path Easement Areas where the golf cart paths and Cart Path Facilities have been relocated), and upon the recording of a new easement agreement, this Cart Path Easement shall automatically terminate and be of...

Examples of Cart Path Easement Areas in a sentence

  • Grantor shall have: (a) the right, but not the obligation, to maintain and repair any improvements installed by Grantor within the Cart Path Easement Areas; and (b) the right, but not the obligation, to maintain and/or repair any improvements installed by Grantee which are not being maintained and repaired by Grantee in accordance with this Agreement if such maintenance and/or repair is not performed by Grantee within fifteen (15) days after written demand therefor.

  • In performing any work within or involving the Cart Path Easement Areas and/or the improvements within the Cart Path Easement Areas, Grantee shall comply with all applicable permits, laws, rules, codes and regulations of ▇▇▇▇▇▇▇ County and/or any other controlling governmental or quasi-governmental agency or entity.
