Independent CE Agreements are valid only between the Company and an individual.
The C&E Agreements taken collectively constitute a settlement or resolution of claims relating to the purchase of energy and capacity purported to be covered thereby for all periods from the Commerical Operation Date through and including September 15, 2007 and do not act to suspend or otherwise delay or toll Seller's rights to seek recovery from the Partnership with respect to such energy and capacity purchases.
