  • In the event of any disagreement between the parties hereto on the application of this Section, the matter shall be referred to a single Chartered Surveyor appointed by mutual agreement or failing agreement to a single Chartered Surveyor nominated by the Chairman for the time being of the Royal Institution of Chartered Surveyors (Hong Kong and China branch) and the decision of the Chartered Surveyor who shall be acting as an arbitrator shall be final and binding.

  • Notwithstanding the foregoing, in the event any dispute to be determined under this Clause 24 is of a technical nature and is not customarily referred to a Chartered Surveyor, then such dispute shall be referred to an expert (each, an “Expert”), who will act as an expert and not as an arbitrator, as set forth below in this Clause 24.

  • The Valuation will be carried out on a Red Book basis by a jointly appointed independent Chartered Surveyor, with reference to the original valuation, with the Purchaser providing its original Appraisal to the Surveyor.
