CHK Agreement means (i) the Amended and Restated Gas Gathering Agreement, dated as of January 25, but effective as of February 1, 2010, by and among Chesapeake Midstream Partners, L.L.C., Chesapeake Energy Marketing Inc., Chesapeake Operating, Inc., Chesapeake Exploration L.L.C., Chesapeake Louisiana L.P. and DDJET Limited LLP, as amended, and (ii) if the agreement described in clause (i) is terminated prior to this Agreement, then “CHK Agreement” means the agreement described in clause (i) as it was in effect immediately prior to such termination.

  • The giving of Notice as contemplated by this Section 2.2(b) shall constitute the giving of the First ▇▇▇▇▇▇▇ Redetermination Notice or Second ▇▇▇▇▇▇▇ Redetermination Notice, as applicable, provided that such Notice is given within the six month notice period for the First ▇▇▇▇▇▇▇ Redetermination Notice or two year notice period for the Second ▇▇▇▇▇▇▇ Redetermination Notice, as applicable, set forth in the CHK Agreement.

  • The Parties agree that the Economic Value of the Total Agreement shall be deemed to be equal to the Economic Value of the CHK Agreement.

  • For purposes of the definition of “Annual ▇▇▇▇▇▇▇ Gathered Volumes” in the CHK Agreement, **% of the Aggregate MV Mitigation Gas for the applicable Year shall be used in clause (ii) of such definition in lieu of the volume of MV Mitigation Gas delivered under the CHK Agreement during such Year.

  • If Gatherer’s right to operate the DFW Gathering System terminates under the CHK Agreement, then Gatherer shall have no further obligation to receive Producers’ Gas and MV Mitigation Gas under this Agreement on the DFW Gathering System from and after the date of such termination.

  • Upon the cessation of the Force Majeure Event, Provider shall use commercially reasonable efforts to resume its performance of any affected Service in accordance with the standards set forth in Section 2.4(a) with the least possible delay.
