Club Operation definition

Club Operation. A business which is primarily engaged in the direct marketing to consumers on a membership basis of audio and video products (for example, Columbia House in the United States or Bertelsmann in Europe).
Club Operation any direct sales to consumers through a record club (for example, sales through Columbia House or BMG Direct in the United States or Bertelsmann in Europe). A "Direct Club Operation" is a Club Operation conducted directly by RISING STAR and not by another Person through a licensing arrangement with RISING STAR (with respect to distribution in the United States and/or Canada) or with RISING STAR's principal Licensee in any territory outside the United States and Canada (with respect to distribution in such territories). (For example, Columbia House and BMG Direct in the United States and Bertelsmann in Europe are not Direct Club Operations.)

Examples of Club Operation in a sentence

  • The Mechanical Royalty on any Record referred to in paragraphs 9.04 and 9.05, or on any Record sold through a Club Operation, shall be three‑fourths (3/4) of the amount fixed above.

  • No royalties shall be payable with respect to Records received by members of any Club Operation in an introductory offer in connection with joining it or purchasing a required number of Records including, without limitation, Records distributed as "bonus" or "free" Records, or Records for which the Club Operation is not paid.
