CMU Issue Position Report definition

CMU Issue Position Report shall have the meaning specified in the CMU Rules;

CMU Issue Position Report means an issue position report issued by the CMU or such other notification, record, certificate or statement issued from time to time by the CMU and relating to the CMU Notes, in accordance with the CMU Rules, to confirm the interest of accountholders in the CMU Notes, as specified in the CMU Rules; CMU Lodging and Paying Agent means, in relation to all or any Series of Notes in the form of CMU Notes, The Bank of New York Mellon, acting through its Hong Kong Branch at Level 00, Xxxxx Xxxxxxx Xxxxx, 0 Xxxxx’x Xxxx Xxxx, Xxxx Xxxx or any successor agent in relation thereto which shall become such pursuant to the provisions of the Agency Agreement or such other agent in relation thereto as may (with the prior written approval of, and on terms previously approved in writing by, the Trustee) from time to time be appointed as such by the Issuer and (except in the case of the initial CMU Lodging and Paying Agent) notice of whose appointment has been given to the Noteholders pursuant to Clause 7.11 in accordance with Condition 12; CMU Manual means the reference manual relating to the operation of the CMU issued by the Hong Kong Monetary Authority to CMU Members, as amended from time to time;

CMU Issue Position Report means an issue position report issued by the CMU or such other notification, record, certificate or statement issued from time to time by the CMU and relating to the CMU Notes, in accordance with the CMU Rules, to confirm the interest of accountholders in the CMU Notes, as specified in the CMU Rules; CMU Lodging and Paying Agent means, in relation to all or any Series of Notes in the form of CMU Notes, The Bank of New York Mellon, acting through its Hong Kong Branch at Level 26, which shall become such pursuant to the provisions of the Agency Agreement or such other agent in relation thereto as may (with the prior written approval of, and on terms previously approved in writing by, the Trustee) from time to time be appointed as such by the Issuer and (except in the case of the initial CMU Lodging and Paying Agent) notice of whose appointment has been given to the Noteholders pursuant to Clause 7.11 in accordance with Condition 12; CMU Manual means the reference manual relating to the operation of the CMU issued by the Hong Kong Monetary Authority to CMU Members, as amended from time to time;

Examples of CMU Issue Position Report in a sentence

• Payments of principal or interest (if any) in respect of such global Note will be made to the persons for whose account a particular nominal amount of Notes represented by such global Note is credited as being held by the CMU Operator at the relevant time, as notified to the CMU Lodging and Paying Agent by the CMU Operator in a relevant CMU Issue Position Report or in any other relevant notification by the CMU Operator.

• The CMU may require that any such exchange for a permanent Global Note is made in whole and not in part and in such event, no such exchange will be effected until all relevant account holders (as set out in a CMU Issue Position Report or any other relevant notification supplied to the CMU Lodging and Paying Agent by the CMU) have so certified.

• Any such notice shall be deemed to have been given to the holders of the Notes on the first day after the day on which the said notice was given to Euroclear and/or Clearstream, Luxembourg and/or the persons shown in the relevant CMU Issue Position Report.

• So long as the Global Note or, as the case may be, the Global Certificate is deposited with a sub-custodian for the CMU, notices to Noteholders represented by the Global Note or, as the case may be, the Global Certificate may be given by delivery of the relevant notice to persons shown in a CMU Issue Position Report issued by the Hong Kong Monetary Authority on the business day prior to the date of despatch of such notice.

• Any such notice shall be deemed to have been given to the Noteholders on the second day after the day on which such notice is delivered to the persons shown in the relevant CMU Issue Position Report.

• Any such certificate or other document may comprise any form of statement or print out of electronic records provided by the relevant clearing system (including Euroclear's EUCLID and/or EasyWay, Clearstream, Luxembourg's Xact Web Portal system or a CMU Issue Position Report) in accordance with its usual procedures and in which the holder of a particular principal amount of Notes is clearly identified together with the amount of such holding.

• Any such certificate or other document may comprise any form of statement or print out of electronic records provided by the relevant clearing system (including Euroclear's EasyWay and Clearstream, Luxembourg's Xact Web Portal or a CMU Issue Position Report) in accordance with its usual procedures and in which the holder of a particular principal amount of Notes is clearly identified together with the amount of such holding.

• Use of recommended form CF-MH 3097, Jan 05 98, “Application for Voluntary Admission – Minors,” which is incorporated by reference as if fully set out here and may be obtained pursuant to Rule 65E-5.120, F.A.C. from the district mental health program office, will be considered by the department to be sufficient to document a guardian’s application for admission of a minor to a receiving facility.

• Any such certificate or other document may comprise any form of statement or print out of electronic records provided by the relevant clearing system (including Euroclear's EUCLID and/or EasyWay, Clearstream, Luxembourg's Cedcom system), or a CMU Issue Position Report) in accordance with its usual procedures and in which the holder of a particular principal amount of Notes is clearly identified together with the amount of such holding.

• Notwithstanding Condition 15 (Notices), so long as any of the Notes are represented by the Global Note Certificate and such Global Note Certificate is deposited with a sub-custodian for the CMU, notices to the holders of the Notes may be given by delivery of the relevant notice to the persons shown in a CMU Issue Position Report issued by the Hong Kong Monetary Authority on the business day prior to the date of despatch of such notice.
