Any controversy or claim arising out of this Contract, including the breach, termination or validity thereof, shall be finally resolved by arbitration in accordance with the American Arbitration Association Rules and Mediation Procedures (including Procedures for Large, Complex Commercial disputes) then currently in effect, by three arbitrators.
The arbitration shall be conducted pursuant to the American Arbitration Association Rules applicable to Commercial disputes.
The parties agree that this Section and the arbitrator's authority to grant relief shall be subject to the United States Arbitration Act, the provisions of this Agreement, and the ABA-AAA Code of Ethics for Arbitration of Commercial disputes.
Such arbitration shall be conducted in accordance with the most recent version of the JAMS/Endispute Rules of Practice and Procedure for the Arbitration of Commercial disputes (the "JAMS/Endispute Rules") as of the date of this Agreement.
Except as otherwise provided in this Agreement, any controversy or dispute arising out of this Agreement, the interpretation of any of the provisions hereof, or the action or inaction of any party hereunder shall be submitted to final and binding arbitration in Los Angeles, California administered by JAMS/Endispute in accordance with the then-existing JAMS/Endispute Arbitration Rules and Procedures for Commercial disputes.
Commercial disputes with either Party’s vendors or contractors specific to the Party shall not give rise to a defense under this section.
The arbitration rules and procedures of the American Arbitration Association for Commercial disputes shall be used in the arbitration hearing and the law of evidence of Oklahoma shall govern the presentation of evidence at such hearing.
Except as modified by this Contract or other written agreement of the parties, the arbitration shall be conducted in accordance with the rules of the American Arbitration Association rules applicable then in effect for Commercial disputes.
