Commercial Operation Payment definition

Commercial Operation Payment means an amount equal to the Total Compensation Amount divided by the sum of Delivery Period in years plus one. For example, a seven-year Delivery Period would receive eight equal payments: the first payment at the Commercial Operation Date (“COD”) and each successive payment at the end of each Contract Year.
Commercial Operation Payment means an amount equal to seventy percent (70%) of the Total Compensation Amount.
Commercial Operation Payment means a percentage of the Total Compensation Amount equal to: 1/(number of years agreed to as the Delivery Period +1). Subject to the terms of this Agreement, such amount shall be payable to the Owner upon satisfactory performance of the conditions listed in Section 2.07 (a)-(i).

Examples of Commercial Operation Payment in a sentence

  • At all times during the Contract Term, Owner shall post on or before the first Calendar Day of each Contract Year, and thereafter maintain during the Contract Year, Performance Assurance in an amount not less than (i) during the first Contract Year, the Commercial Operation Payment and (ii) during each subsequent Contract Year, the Commercial Operation Payment multiplied by (y) the number of remaining Contract Years and divided by (z) the number of Contract Years in the Delivery Period.

  • Within twenty (20) Business Days of receiving an invoice from Owner for the Commercial Operation Payment, CHGE shall make payment of all amounts invoiced by Owner for the Commercial Operation Payment.

  • Commercial Operation Date means the date on which a Material Project is substantially complete and commercially operable.

  • Commercial Operation means the condition of operation in which the complete equipment covered under the Contract is officially declared by the Owner to be available for continuous operation at different loads up to and including rated capacity. Such declaration by the Owner, however, shall not relieve or prejudice the Contractor of any of his obligations under the Contract.

  • Commercial Operations Date or "COD": The date on which Facility first achieves Commercial Operations.

  • Commence commercial operation means, with regard to a unit that serves a generator, to have begun to produce steam, gas, or other heated medium used to generate electricity for sale or use, including test generation subject to the following:

  • Initial Operation means the first integral operation of the complete equipment covered under the Contract with the sub-system and supporting equipment in service or available for service.

  • Total Operating Expenses means all costs and expenses paid or incurred by the Company, as determined under generally accepted accounting principles, that are in any way related to the operation of the Company or to Company business, including advisory fees, but excluding (i) the expenses of raising capital such as Organization and Offering Expenses, legal, audit, accounting, underwriting, brokerage, listing, registration, and other fees, printing and other such expenses and tax incurred in connection with the issuance, distribution, transfer, registration and Listing of the Shares, (ii) interest payments, (iii) taxes, (iv) non-cash expenditures such as depreciation, amortization and bad debt reserves, (v) incentive fees paid in compliance with the NASAA REIT Guidelines, (vi) Acquisition Fees and Acquisition Expenses, (vii) real estate commissions on the Sale of Properties, (viii) Financing Coordination Fees and (ix) other fees and expenses connected with the acquisition, disposition, management and ownership of real estate interests, mortgage loans or other property (including the costs of foreclosure, insurance premiums, legal services, maintenance, repair and improvement of property).

  • LWDA PAGA Payment means the 75% of the PAGA Penalties paid to the LWDA under Labor Code section 2699, subd. (i).

  • Individual development account means a contract between an account holder and a fiduciary organization, for the deposit of funds into a financial institution by the account holder, and the deposit of matching funds into the financial institution by the fiduciary organization, to allow the account holder to accumulate assets for use toward achieving a specific purpose approved by the fiduciary organization.

  • Railway Operation Date means the date of the first carriage of iron ore, freight goods or other products over the relevant Railway (other than for construction or commissioning purposes);
