Commercialization Field definition

Commercialization Field means the development or commercialization of Products for the prevention, treatment or diagnosis of Heart Failure and ischemic cardiomyopathies in humans and other animals.
Commercialization Field means the treatment and prevention of human diseases and conditions.
Commercialization Field means, collectively, the Diagnostic Field and the Therapeutic Field.

  • Subject to the terms and conditions of this Agreement, Gene Logic hereby grants and agrees to grant to P&GP an exclusive, worldwide license under Gene Logic's Patent Rights, if any, to use each Gene Target for which P&GP has paid the fee described in Section 9.3 to develop, make, have made, use, import, offer for sale and sell (with the right to sublicense) Products for use in the Commercialization Field.

  • Additionally, CURAGEN shall have a period of fifteen (15) business days from receipt of any draft patent application to add any proper claims and specifications outside of the PIONEER Commercialization Field.

  • PIONEER agrees that it will use reasonable efforts to develop and market Licensed Products in the PIONEER Commercialization Field throughout the Territory at its own expense (the "Development Program"), but only to the extent that the development and commercialization of such Licensed Products is economically practicable and the market for such Licensed Products justifies, in PIONEER's reasonable determination, such development and sale.

  • There will be no additional fifteen (15) minute evening relief period if that relief period is combined with the paid supper period as provided in Section V.C.2 above.

  • PIONEER will perform research in order to develop products and technology based on the genes and other research results discovered by CURAGEN and will grant to CURAGEN an option to license the results of such research in the territory for the purpose of the development, testing, manufacture and sale of products in the CURAGEN Commercialization Field (as hereinafter defined).

  • PIONEER shall continue to pay royalties to CURAGEN at the rate as set forth in Section 8.4. In addition, the limitation imposed on CURAGEN under Section 8.1.3 shall cease and CURAGEN shall be free to commercially exploit CURAGEN Research Results, Joint Research Results, CURAGEN Proprietary Intellectual Property and Joint Proprietary Intellectual Property in the Other Commercialization Field.
