Common Facilities Expenses definition

Common Facilities Expenses means the reasonable and customary aggregate expenses incurred by Landlord in the management, operation, maintenance and repair of the Common Facilities, all determined in accordance with sound management principles and generally accepted accounting practice on an accrual basis and the cost, as reasonably amortized by Landlord, with interest at the rate per annum determined pursuant to Article 34 on the unamortized amount, of (x) any capital improvements to the Common Facilities made after the Commencement Date which reduce other items of Common Facilities Expenses, but in an amount not to exceed such reduction for the relevant lease year and/or (y) any reasonably necessary capital repair and/or replacement of the Common Facilities. Common Facilities Expenses shall include, but not be limited to: (i) Expenses of the types specified in subparagraph (a) above but applicable to the Common Facilities; (ii) Real property taxes as defined in Article 7 and all other taxes with respect to the Common Facilities; (iii) Repaving, resurfacing, painting and striping, sweeping, trash removal and security with respect to the Common Facilities; (iv) Advertising and similar expenses for the general promotion of the Center (but not including any advertising expenses incurred to procure tenants for vacant space); and (v) An amount equal to fifteen percent (15%) of all such costs and expenses to cover Landlord’s overhead and administrative expenses with respect to the Common Facilities.
Common Facilities Expenses means the aggregate expenses incurred by Landlord in the management, operation, maintenance and repair of the Common Facilities, all determined in accordance with sound management principles and generally accepted accounting practice on an accrual basis and the cost, as reasonably amortized by Landlord, with interest at the rate per annum determined pursuant to Article 34 on the unamortized amount, of any capital improvements to the Common Facilities made after the Commencement Date which reduce other items of Common Facilities Expenses, but in an amount not to exceed such reduction for the relevant lease year. Common Facilities Expenses shall include, but not be limited to: (i) Expenses of the types specified in subparagraph (a) above but applicable to the Common Facilities; (ii) Real property taxes as defined in Article 7 and all other taxes with respect to the Common Facilities; (iii) Repaving, resurfacing, painting and striping, sweeping, trash removal and security with respect to the Common Facilities; (iv) Advertising and similar expenses for the general promotion of the Center (but not including any advertising expenses incurred to procure tenants for vacant space); and (v) An amount equal to ten percent (10%) of all such costs and expenses to cover Landlord's overhead and administrative expenses with respect to the Common Facilities.
Common Facilities Expenses means the costs and expenses associated with operating and maintaining Common Facilities (other than Common Expenses) as set forth in the Operating Agreement as allocated among one or more units located at the Site, including Waters River I, Waters River II, and the Facilities, in accordance with the percentage of each unit’s design capability, expressed in MWs, to the total of the design capability, expressed in MWs for all units located at the Site.

Examples of Common Facilities Expenses in a sentence

  • Owner agrees that Owner shall have the right to take such actions as Owner believes are necessary to reduce the Common Facilities Expenses, including, without limitation, appealing real estate taxation or assessments applicable to the Common Facilities, but subject to the terms and conditions of the REA.

  • Only the amortization applicable to a particular calendar year shall be included in Building Operating Expenses or Common Facilities Expenses, as the case may be, chargeable to Tenant for such calendar year.

  • Manager shall pay all Common Facilities Expenses owed and applicable to the Premises prior to January 1, 2017 directly to the appropriate party under the REA and any other applicable Restrictive Agreement for each Agreement Year, which shall be computed and paid in accordance with the REA and other applicable Restrictive Agreement.

  • The parties acknowledge that the operation of the Project Common Facilities may from time to time (but shall not be required to) involve security personnel, equipment, and/or procedures, the costs of which (to the extent provided and generally applicable to the Project as opposed to a particular building within the Project) shall be included in Project Common Facilities Expenses.

  • Owner agrees that Manager shall have the right to take such actions as Manager believes are necessary to reduce the Common Facilities Expenses and real estate taxes, including, without limitation, appealing real estate taxation or assessments applicable to the Common Facilities, but subject to the terms and conditions of the REA.
