Each Owner covenants that in the event of any damage or destruction to the Common Areas, including Common Parking Spaces and Common Utility Facilities on its respective Parcel during the term of this Declaration, by any cause whatsoever, whether insured or uninsured, it shall restore, repair or rebuild the Common Areas with all due diligence to the condition that existed immediately prior to such damage.
Section 7.1 Restoration of Common Areas (including Common Parking Spaces and Common Utility Facilities).
Each Owner and its Permittees are hereby granted the nonexclusive right to use the Common Area, including the Common Parking Spaces, subject to such reasonable, nondiscriminatory rules and regulations for the use of such Common Areas as may be promulgated by the Managing Owner, from time to time, and subject to the requirements of the Master Development Agreement and Proffers.
The Common Parking Spaces shall be maintained by the Managing Owner as a part of the Common Area, as set forth, and in accordance with, Article 5 below.
Each Owner hereby grants, establishes and reserves unto each of the Owners and itself for the benefit of each Owner and all Permittees, easements in the Common Parking Spaces, for the nonexclusive right to use all of those parking spaces located within the Property and designated as Common Parking Spaces on Exhibit “C” hereto, for the parking of vehicles, subject to the reasonable, nondiscriminatory rules which may be established by the Managing Owner.
Upon completion of the Parking Improvements, the Parking Improvements shall be Common Parking Spaces under the REA.
The Common Parking Spaces are sometimes collectively referred to as the “Parking Areas”.
Landlord reserves the right to designate reserved spaces for Tenant's Common Parking Spaces at any time and from time to time.
The Allottee hereby further warrants and confirms that the Allottee shall, upon formation of the Maintenance Society, cause such Maintenance Society to confirm and ratify and shall not permit the Maintenance Society to alter or change the allocation of Common Parking Spaces in the manner allocated by the Promoter to the various purchasers (including the Allottee herein) of the apartment(s) in the Project .
All Common Parking Spaces and any other parking areas, roadways, and driveways used by Tenant, its personnel and visitors will be at their own risk, and Landlord shall not be liable for any injury to person or property, or for loss or damage to any automobile or its contents, resulting from theft, collision, vandalism, or any other cause whatsoever.
