Completion and Performance Security definition

Completion and Performance Security has the meaning ascribed to it in Section 6.1(a). “Confidential Information” means:

  • If the amounts then due and owing are less than the amount drawn under such Letter of Credit, then such excess amount shall be held as Completion and Performance Security.

  • Where the Generator has so terminated this Agreement, the AESO shall return any Completion and Performance Security it holds within twenty (20) Business Days following receipt of a written request from the Generator.

  • Whether or not any Optional Termination Amount is payable by the AESO to the Generator, the AESO shall return any Completion and Performance Security held by the AESO to the Generator within twenty (20) Business Days following receipt of a written request therefor made by the Generator following the Termination Date, net of any amounts owing by the Generator to the AESO.

  • The obligation of the Service Provider to post and maintain Completion and Performance Security must be satisfied by the Service Provider providing to the IESO a certified cheque, bank draft or money order issued by a bank listed in Schedule I, II, or III of the Bank Act (Canada) for the full amount of the Completion and Performance Security.

  • In such instance, the connection applicant explicitly authorizes the IESO to recover outstanding amounts under the invoice from the connection applicant’s Completion and Performance Security, provided to the IESO or the OPA, as applicable.

  • If termination for a Generator Event of Default occurs prior to commercial operation of the facility, Generator will pay, as liquidated damages, a sum equal to the Completion and Performance Security (i.e. $50,000 per MW of Contract Capacity) and AESO’s remedies are limited to such amount.

  • Additional Performance Security shall have the meaning set forth in Clause 7.1;

  • Interest Free Security Deposit/ Performance Security means interest free amount to be deposited by the Licensee with DMRC as per terms and conditions of License Agreement as a security against the performance of the License Agreement.

  • Performance Security means monetary guarantee to be furnished by the successful Tenderer for due performance of the contract placed on it. Performance Security is also known as Security Deposit or Performance Bank Guarantee.

  • human performance means human capabilities and limitations which have an impact on the safety and efficiency of aeronautical operations;

  • Guaranteed Liabilities means all moneys, obligations and liabilities expressed to be guaranteed by the Guarantor in clause 2.1;

  • Non-Guaranteed Elements means the premiums, credited interest rates (including any bonus), benefits, values, dividends, non-interest based credits, charges or elements of formulas used to determine any of these, that are subject to company discretion and are not guaranteed at issue.   • energy performance contracting means a contractual arrangement between the beneficiary and the provider of an energy efficiency improvement measure, verified and monitored during the whole term of the contract, where investments (work, supply or service) in that measure are paid for in relation to a contractually agreed level of energy efficiency improvement or other agreed energy performance criterion, such as financial savings;

  • Guaranteed elements means the premiums, benefits, values, credits or charges under a policy of life insurance that are guaranteed and determined at issue.

  • Energy Performance Score means the numeric rating generated by Portfolio Manager that compares the Energy usage of the building to that of similar buildings.

  • Guaranteed Cash Management Agreement means any Cash Management Agreement that is entered into by and between any Loan Party and any Cash Management Bank.

  • Performance and Guarantee Test means all operational checks and tests required to determine and demonstrate capacity, efficiency and operating characteristics as specified in the Contract Documents.
